Muscovies in US - REGULATION CHANGES OPEN FOR COMMENTS - 10/1 update

Quote:
I expect that an amendment will take nearly as long as the current revision took. There is already in place a procedure for making and amending the regulations, and by law they must be followed (due process). Note that the regulations that go into effect at the end of the month are themselves a revision. I do not know whether or not there are procedures for expediting amendments.

Thank you, that is exactly the point I keep trying to make. Everybody keeps saying "he said" , "they said" , "I heard" but nobody has anything in writing do they? When I ask specific questions the FWS in Atlanta (the permit office) dances all around the subject, she said "they would send out a mass mailing when the regulation has been tweeked " She would give no time and only said it takes time. DR Allen when pressed for specific details will not respond

I hate to say this but it was up for notification TWO years ago and if I remember right from what I read 14 people responded. No law can go on the books without public input.

And until the regulation is changed and on the books it still takes effect March 31st as it is written right now

You can't sell
you can't breed
you can't buy

I did post a link with all the contact information in the duck section last year about this time so people could complain them. I didn't get too many responses... in fact several people made comments about how this wasn't actually going to happen.

I did write in and state my view and that I did not agree to several of the addresses I listed. If no one else did, I can't help you there.

But the point is, I don't agree with this, I made my views heard and I STILL don't agree.

I would find it hard to think that any state with the possible exception of Florida is going to make this any kind of priority.
With the economy the way it is I can't imagine the individual states putting any money or man-power into this nonsense.
As for me things are just going to be business as usual.

Our staff contacted George Allen this morning, and spoke to him on the phone. He says that this regulation will go into effect, but there will be no enforcement until an amendment will be put together that allows Muscovy raisers to keep their birds without a permit. As of 3/18/10, any persons trying to enforce this law should be directed to him for further information. He is currently putting this in writing and will send you a copy upon request once it is completed.

In summary, this regulation is on hold as of 3/18/10 and will not be presently enforced until a new draft of this regulation is completed. Please send your comments to [email protected].

I plan on writing Dr. Allen and requesting a email statement to effect that "Said Reg. 50 CFR 21. concerning Muscovy Ducks, is on hold as of 3/18/10 and will not be presently enforced until a new draft is completed." and ask him to sign it and send it out to everyone requesting it.
Then it will be business as usual unless I hear differently. Can't hurt.

Just wrote to Dr. Allen. Here it is, for what it's worth.

Dear Dr. Allen,

Thank you for taking the time and effort to address the concerns of the Muscovy Duck Community. I do have a small request and hope that it will help address a concern of mine and many others. Would you please compose a short email notice something to the effect of: Regulation 50 CFR 21., concerning Muscovy Ducks, is on hold as of 3/18/10 and will not be presently enforced until a new draft is completed." Signed and dated by you? You could then send it out to those requesting it as proof of the legality of our owning and raising Muscovy Ducks especially after the March 31st, deadline. Thank you for your attention to my concerns in this matter.

Sincerely,
Barb Houtman

Thank you keeperofthehearth. That is a great idea and a really nice letter.

I hope Dr. Allen responds.

Does anyone know what (if anything) the American Poultry Association (APA) and the International Waterfowl Breeders Association (IWBA) is doing about this?
I would think that they or even the Society for the Preservation of Poultry Antiquities (APPA) would have something say about all this..
