must get rid of my chicken for zoning requirement what should i do

I live in Kansas city MO and the laws say it has to be 100ft away form the people you live by to have chickens. well i asked the people who live next door and they said it was ok the other house has been for sale for over a year doesn't look like it's going to be for sale for long while!!! i got some baby chicks in Nov and didn't get the coop build till this week and it just shy of a 100ft away did think that was a big deal because the people next door love the chickens as much as i do!! but i am not sure of the people who live up the way but they are over 100ft away and to me it effect them and so today while we were out and about buying stuff for my chickens i came home to thins note from Neighborhood and community services department animal health & public safety saying i am in violation and don't meet zoning requirements all chickens must be removed which form what i looked up all it has to be is 100ft aways and no rooster which i don't have i only have two and they don't make a noise at all dogs make way more noise then they do. it doesn't even look like that who ever came by even came to my back yard they just looked back there and wrote the note. i just wish who ever had called them would have came to me 1st as all weekend i work so hard to put up there very nice coop and was outside and willing to talk and i know for a fact its not my next door neighbors it just dumb people who live down the way that don't like me or them. I am just very heart broken i love my chickens i am just shy 2 ft and thought if the people next door was ok with it would be fine i just don't know what to do i try to call the offices but they are closed for the day i don't know if i should just bring my gals in or what . it only 2 ft and if it bug the people who lived two house down i would have talked to them and try to win them over it just makes me so mad and sad

i have a feeling i will have to find new homes for them is there anyone out there who lived in kc mo that would like to take them off my hand plus some new chicks we just bought if so email me at [email protected]

I wouldn't worry about it until someone says something. But thats just me.

Can you move the coop enough to make it in compliance with the 100 foot setback rule?

I know you're very upset but, it sounds to me like you have all the ammo you need. You community allows poultry!!! most folks who are in your situation don't have a leg to stand on. You write back to that community whatever and tell them you pay your dues/taxes and you are in compliance with the law and that any further harrassment will be treated as such. Asking you to remove your family pets in which you have grown to love and in which you obtained legally is outright unjust!

Apply for a setback variance. With the agreement of your neighbors, you should be in a very strong position.

It sounds to me that whomever from the Neighborhood and Community Services Dept wrote you the note doesn't know the laws for that area. Take them a copy of them. And if you feel the need, ask your neighbor to write a letter of consent IF the 2ft. issue comes up.

we had somebody call the county code enforcment on us and told them that we built without a building permit and the chickens smelled bad which they dont you can never smell them unless it rains and its not even tht bad just when the wind blows then its gone it never lasts more than a day or two, put we are in compliance and the building code says anything bigger than a 10x10 has to have a building permit mines a 8x8 haha so we passed and we live out in the middle or nowhere but a neighbor way up the road was just trying to cause problems like he calls on everybody about everything cause he has nothing better to do. but anyways thwy wanted us to get rid of them and gave us 30 days or we would be fined so i got on the phone and called my county council man and told him about it and he said dont worry about it ill handle it and just tear up that paper they left you. so we havent heard anything since lol
