Not so. You are obligated in every state in the country, to operate your vehicle in an alert manner and at such a speed that you will be able to react in a timely manner to such events.

Ever get rear ended? The driver probably said "WHY did you stop?" but the reality is, that he was NOT paying attention OR driving with enough reaction time to stop.

Ever see a car off the road from hydroplaning in a rainstorm? I guarantee the driver got a ticket for driving too fast for the conditions. Same thing for snowstorms.

It comes down to being responsible and being alert to what's going on around you. I hit a dog once, broken leash trailing behind, it was my fault too. I seen him coming but just didnt think that he would KEEP coming. I should have stopped and I had plenty of time to do so. I was late for meeting a friend for coffee and was rushing. I stopped and did the right thing with the owner.

It's choices.

Baloney. Ive hit animals on the road before, and the only choice I had to make was DO NOT SWERVE INTO TRAFFIC. Ive had dogs run out in front of my car when I never had a chance to see them before it was too late. Ive had a humongous pileated woodpecker slam into my windshield, never saw him coming. I know people who have swerved to miss hitting animals and got into wrecks, or hit other cars. Its insane that people think its OKAY to let animals roam, and then have the nerve to blame the drivers.

Exactly. The guy speeding and the animals getting hit are kind of 2 separate issues. It is an animal owner's job to keep their animals safe. OFF THE ROAD counts as safe in my book. As for speeders, we had the same problem on our road. After several dozen calls to the sheriff's office they decided we weren't going to shut up until they did something about it so they finally started patrolling our street

Can you build the chickens a tunnel to go UNDER the road?

Here's what "a friend" did to solve a similar problem. There was this car that would speed down the street at all times of the day/night. 8 houses on the street, 5 have kids. He would wave at them to slow down when they went by but to no effect. One day he was getting the mail and a piece of mail fell out of his hands and he bent over to get it. At that moment, the car went speeding by. Instantly, a plan was born!

He sat across the street in some bushes and waited. When the car came back up the street, he waited until it was about 100' away and he ran about 10' into the road - then turned around and ran back to the bushes. The car tried to stop but it was too late, the car went into a skid and ended up in a small ditch, snapping off a tie rod. He goes over to the driver to check on him and the driver starts yelling at him about running out in the road. He replies that he was simply crossing the road but had to run back after he seen him coming.

Because the car could not be driven, a tow truck was called. But that was not good enough for "my friend". He wanted to put an end to this for good so, he calls up the local police. They arrive and the driver starts yelling that my friend ran into the road and forced him off the road, smashing the front end of his car. The police measure the skid marks, verify the position of "my friend" in the road (who said he was retrieving a piece of mail that blew out of his hand) and fined the driver for excessive speed in a residential zone. They gave him a reckless driving ticket, speeding and a nice fine for failure to carry proof of insurance. The officer told "my friend" that after all was said and done, the driver would get $450 in fines, a day in court and probably 6 points on his license. Plus the estimated $700 - $1,000 damage to the car and $225.00 tow and storage of vehicle at $25/day

"my friends" wife was not impressed with the event and proceeded to deliver a 10 minute lecture on the dangers of what he did. After she was done, his only response was, "If that car had hit one of OUR kids or a neighbors kid, YOU would be out here yelling at ME, asking me WHY - I didnt do something about it sooner! Now we wont have to worry about that and your welcome. "

Since this incident, "my friend" hasn't had a speeding car on his street in almost 2 years!!

So I said all that - to say this: "you can post all the signs you want. Some people ONLY respond to object lessons and sometimes you just have no choice but to get their attention in a way that they can understand the importance, of what your saying".

that is kind of a lousy thing to do..the guy couldve been hurt. it wasnt his job to teach anyone a lesson, especially one that could kill or maim someone.

If your animal leaves your property, it is at full risk to whatever is out there.
It's in your best interest to keep your animals on your side of the fence (that means build one if you don't want your birds hit in the road!)

They can be trained to avoid the road, if they are just transitioning into the out-of-doors. They'd follow Cass around when she was raking (turning up bugs) and when they'd get near the road I'd take out the car and then return gunning the engine and honking. Cass would take off up through the trees and her flock would follow. They have never gone within 10yds of the road. Same with shooting preds while they're ranging. If one of us takes a single shot, they might look up. If a rapid series of shots (something big coming fast!), they all run under the deck and growl/whine.

You might try some sort of aversive conditioning, but I don't know if it would take in adult chooks.

Agreed, but the OP's main issue was that they didnt stop. The other issue was the speed. If you live on a 25MPH road, it's pretty hard to NOT see a chicken, in the daylight - IF your observing the speed limit AND the posted signs.

Well, I as his wife would have yelled at him...but me not being his wife can laugh and say "GOOD FOR HIM".

I'm sorry for your loss. It always hurts to lose a pet.

That being said, it's probably time to fence them in. If they are in the road, they'll just keep getting hit.

Another concern regarding all of this....What if this had been a kid...they were going to fast to stop for a kid. But also...where I live, there is what is called "open space or range land". If you hit livestock (usually referring to cows) you - the car driver are liable and have to pay. But if you hit a dog, horse, whatever the owner of the animal may be liable for any damage. May want to check out this. Would hate it if you (chicken owner) got in trouble because someone had a car wreck avoiding hen. Well it is now thundering and lightening here so I gotta get off the computer. Wind is also blowing hard. What a storm.....see ya' all tomorow. I am sorry about the loss of your hen...they all mean so much to us. Night all.

right but he hadn't hit a child, and the guy basically caused someone to wreck intentionally..if i knew who it was and where it happened, i would call the police myself. that is completely wrong. and then to lie to the police and drag them out because of the wreck he caused, that makes it even worse.
