Neighbor's Dogs Killed 18 Chickens

My gut feeling is that they are planning to skip.
Now hit them with the real cost of your loss.
If it goes to court, they will probably whittle
the cost down, so start high with room to play

around here a POL goes from $10.oo and up.
don't say anything about them beint pets and/or how you loved them.
keep it businesslike. as an investment.
you won't get anything for pain and suffering..
you can bet those people would be going after somebody if one of their dogs got shot.. this is no different..

Do as you wish but if the couple are no longer residents of Kansas you will likely need to go to Federal Court to press your claim. The reason is because it then becomes an Inter-State and it is no longer an Intra-State matter. This will also likely involve hiring an attorney licensed by the Federal Court System.

This legal advice is worth what I charged you for it. Keep that in mind.

The damage was done while the owners were in the state, so I think it's a local matter. The chicken owner could file a small claims suit, and the dog owners would have to leave GA to appear in court. If they don't show up the judgment would probably go against them, and then the chicken owner could file a lien against their house until he gets paid. I think that's how it works.

I mean esp if I raised them from chicks and they finally just started laying. I would have a hard time not hating these mutts that helped themselves to massacre my flock. Of course untrained dogs know no boundaries though, not really their fault (I absolutely hate saying that)
Your post convinced me to lock up my flock when I leave. 1/2 mile down the road and they still found themselves there?
The fact the husband didn't get out of the vehicle to apologize speaks volumes...hope this never happens to me Cus I may end up in jail :mad:

a half mile to a dog is hardly a good start on a jolly run.
the fact that the dogs hung around and were glad to see people shows that they were just having some fun. they didn't know any better.
we don't know if the people own their home or are renting. so maybe a lien is useless.
I thought the same thing. the guy let his wife do the talking and crying. all he wanted to do was get the heck out of there asap..
if I ever went to small claims court again, I would have a lawyer. especially if the other party has one.
and if I went through the expense of a lawyer, I would skip the small claims court if I could and go the trial route.
there is a $5000.oo limit in our small claims court here in Wisc.
if you would even win in small claims, and they are in another state, how are you ever going to collect ?
