Neighbors Nuisance Dog

You have the legal right to kill the neighbor's dog since it was attacking and killing your chickens. The neighbors did nothing to keep their dog inside their house. So you have the upper hand since they owe you $ for every chicken their dog killed since the dog was on your property.
 
Anyone can send a certified letter on ANY kind of letterhead. I would call a number on the letter and see if they even exist. Where you live would be helpful to us in research of laws. The people on here are VERY helpful, but you have to give them a little help also. I think they are just trying to rattle your cage because they were irresponsible in their handling of the situation.
 
Dont do it say this, well your dog killed "x" amount of my chickens "but we gave you money for ONE chicken" Well your dog killed more than one and your husband let it out and it killed a chicken right in front of us. My chickens are more valuabe then your killing machine. And plus you were trying to get rid of it.

I would keep the phone messages and any letters. Write notes about any interaction with them. Keep it all in a file with dates and times. Document everything.

What restrictions are they talking about? Ask for a copy of the rule they say you are breaking.
Is it county ordinance or Home Owners Association covenenats? That will make a difference in what they can do.

Even if it is against covenants to have chickens, you still have the right to protect your property from her loose dog. She broke the local leash laws by allowing her dog to run loose and she is still responcible for damage done by her dog.
 
Send them a letter back stating basically everything you started this thread with, and threatening legal action of your own if they do not cease and desist their groundless threats of frivolous legal action against you. You might also let them know in the letter that were YOU to decide to persue the issue in court, they would no doubt be held liable, based on the leash laws they have been ignoring.
 
Restrictive covenants on the property. etc. when the original owner sold the land she put them on there. There are five tracts (properties) in what they call the "subdivsion". Its in the country which is totally weird to begin with. There is no homeowners association. I went to the registers office and got a copy cause I didnt believe anything that was sent to me. The crazy thing too, is one of the buildings on her property is out of restriction. All of the detached buildings must be of wood, vinyl, western cedar. Metal isnt listed. They also must have a composite shingled roof. It is a metal pole barn. I'm serious. So it gets even deeper. LOL. We went to one neighbor to ask him about the chickens and if he was offended by them, and his response was "there are restrictions on these properties"... um yeah. So this is what we are dealing with. All over anothers irresonsibility, and the wrath of their fury.

We can go on for 50 pages of who's right and wrong, but it's a waste of time without knowing what those restrictions are. It's obvious to see that your husband was justified , but what is the law???
