Neighbors Nuisance Dog

Might just want to send their lawyer (aka BIL) a copy of the LAWS regarding dogs running amuck and posing a danger to the community at large via certified mail. Obviously, he missed that part somewhere along the lines.

Also, send him a copy of your restrictions with their code violations highlighted and maybe pictures of the offending structure(s).

You guys can keep at this all day... and seriously, anyone can sue any body for any reason - reasonable or not - and, sadly, more times than not it'll be the stupid idiot who was in the wrong, but who brought the suit who'll end up the winner. But given the [alleged] damages of this incident for either side, it will more than likely have to be in small claims court. Not worth an attorney for either side at that rate.

BEFORE you get an official court notice tho', you need to be sure to dot all your "i's" and cross all your "t's" 'cuz it's all about C(over) Y(our) A($$). That will include keeping a copy (for your records) of EVERYTHING involved with this mess and keeping it where you can be sure to find it if and/or when the time comes.

If it does come down to a court hearing? Be prepared to file a countersuit for the same charges and property damage as well as attorney fees (if you hire one) and court costs.

I was sued by a neighbor (although not over chickens), and I feel your pain. It's very easy for someone to pay a lawyer to send an angry letter. It's a fairly cheap way for your neighbor to try to intimidate you, and she might have no intention of going any further than that, so maybe you can ignore that letter. If you can afford your own bloodsucking attorney, it might be worth it to consult with one so you know where you stand. It sounds like your neighbor broke actual laws with her dog running loose and killing your poor chickens, but you only violated some restrictive covenants. And you had every right to shoot that darn dog. Sorry for your troubles and good luck!

Verify he is a lawyer with this firm. Don't call the number on the letter. Look up the firm online. If there is a website, the lawyers would probably be listed. Or call and verify. If he is not a lawyer, let the lawfirm know this guy is posing as a lawyer with their firm. If the lawfirm doesn't exist, that has to be breaking some law and I would turn that over to the DA.

If he is a lawyer, send him and her (by certified mail) the restrictions and highlight the ones she is in violation of. Also send a copy of the laws regarding protecting your livestock.

If I were you...and I have been there several times over strange things...I would contact my own lawyer. Have him write up a responding letter and send it to their 'lawyer' in response. I would not try to fight it yourself. It will just eat you alive trying to counter their every strange move. A letter from an attorney on your behalf will go much further than one written on your own. Plus, you will then have the laws explained to you and know exactly what you are up against. It is usually not very expensive to have a letter written and a lot of attorney's offer free consults!!!

One of my court visits was over a neighbor's dog who repeatedly attacked mine while they were in their kennels. Their reasoning why they weren't at fault? Because my dogs aren't neutered

Mine are show dogs and must remain intact to be shown...the judge thanked me for my honesty and fined the owner! Some people!

Good luck...keep us posted

i think you should go on Judge Judy. She once awarded a woman $2,500 because a neighbor's dog came onto her property and attacked her duck. She seems to be very fair when it comes to dogs attacking neighbor's pets. Plus, you would get a nice vacation in Los Angeles.
