Yes it was posted that the troublemakers bought after the chicken family.

I feel so bad for your situation. Have you considered a harassment lawsuit against the neighbors? It would be something you might want to think about.

Despite what some people think prejudice is alive and well in the US. Unfortunately.

So sorry you are going through this, but the law seems to be confusing its say no fowl, this included chickens you are reading it as to say small animals as pets. So you see your chickens as pets. Most people don't they are considered a farm animal. I Am not agreeing or disagreeing with either you or your neighbor. Just stating things the way I am understanding them. If it was me I would find another place either sell your home or rent it out. I think it is time to throw in the towel and walk away. I am really sorry about all of this. I hope and pray that you can find an answer to these problems.

I'm really confused by the newspaper article. If an ordinance prohibits chickens, it would seem a simple case that would not require a nuisance lawsuit. Even a pet chicken is a chicken.
 
Mr Hollywood Chickens- Sorry to hear about your trouble with an unreasonable neighbor. She must be a very unhappy woman, to try to take away something that makes your family so happy. I pity her. Maybe, in the end, some compromise can be reached. Perhaps to reduce the size of your flock, so

Now, you say you are from North Africa. I must say, when I saw the video I was surprised to see you were light skinned. No offense intended. It's just that I have a close friend who is from North Africa (Sudan). And dear Stephen is one of the darkest-skinned people I know. So, along with what, in my ignorance I assume to be a jewish skullcap (again forgive my ignorance of the correct word here), I am curious as to your nationality. Stephen is Christian, and I know there are many, many Muslims in Sudan. If you don't mind me asking, what country are you from in North Africa? It has no bearing on your neighbor issues, but I am curious about the world. I truly do not want to offend anyone here, but I am just interested in people, and our differences, and also, how people who are so different can have so much in common.

We tried a compromise many times but she refused and said that the only way she would be happy is if we got rid of all of them, we offered to move them to the other side of the house (the other neighbor asked us to, but we haven't yet because we would need to build a new coop and if she isn't going to stop it would just be a waste of time, the judge was even considering having her pay the price of the new coop!

Elmo: you are right if it was illegal the police would take them away, or code enforcement, or the board of health (they called them also), or animal control (called them too).

92.36 says how chickens should be kept, and in the property zoning it says that this property can be used for agriculture.

What I really hate is that, I have a light skinned friend with 40 meat birds, over 15 hens, 4 large dogs, and a property my size and no one bothers her.

Do you have an attorney? With those kinds of numbers involved with fines, ya really should get one. The opposing attorneys outlandish suggestion that you must have drugged the chickens should have been objected to immediately. And if it was allowed, he should have been queried as to what he was basing that assertion on, as "being too quiet to help his case" wasn't reasonable. Further, you could have offered to let them take a blood sample and have it tested, etc.

It sounds like the Judge in the case might be attempting to give you some latitude, but there is only so much she can do. It's still up to you to put up an adequate defense, make properly timed objections, motions, etc. What proof do you have that she baits the chickens? If it truly is proof, that could be HUGE for your case. And lead to an actual criminal charge against that neighbor.

I ask because you said you sent a tape to the Judge. Did you follow the proper procedure for submitting evidence to the court? Did you also send a copy of it to the prosecutor? One thing I would suggest, is to stop merely defending yourself against the whacked-out womans allegations. Have neighbors seen this behavior? Has she made remarks to them that might help your case? Go on the offensive, and do it like a bulldog, legally. It sounds like you have enough evidence to look into harassment charges, particularly if there is evidence of a race issue, and even more particularly if the Judge herself is on record in acknowledgment of it.

Fighting back isn't good enough, you have to fight back to the point where YOU are the one making them worry. Metaphorically, she just keeps throwing mud at your wall, hoping some of it sticks. And you keep trying to clean it off. Well, start throwing mud back at her wall . . .maybe mixed in with a few large metaphorical rocks.

On the race issue, you have to put that in perspective. In a nutshell . . . . who cares? Why these folks don't like us is, in all actuality, irrelevant. If someone is making my life miserable, I don't care why they are doing it, I care that they are doing it, period. If they don't like my shoes, or my bald head, or the fact I drive a Ford and not a Chevy, I don't care.

Because I'm black? White? Green? I don't care. Feel free not to like me for whatever reason you feel like, I don't care. What I care about is how that dislike manifests itself. And that I will not tolerate.

Ok I have read most not all of the post here just couldnt get through all before I had to say something. I would be happy to have you for a neighbor. Luckly we live in a neighborhood where all of my neighbors are pretty cool with us having chickens even the roosters but I was worried at first. That being said every neighborhood changes and whos to say someone wont move in like in your case and cause trouble. Like you we are allowed to have chickens, but unless you live in the country you always worry about someone making false accusations. I am sorry this lady is going through personal problems but that doesnt give her the right to cause problems for everyone else and honestly the color of someones skin should not be a factor in anything sadly alot of times it is. God made all of us some he chose to give a little more color to. If I could I would move but I know that is not possible for you right now and for that I am very sorry but at the same time you should not have to move. People should learn a lesson from chickens. In my flock I have red white black brown and mixed color chickens they all live peacefully and acceptingly with each other. As far as keeping chickens on your own property I work very hard to do that but there have been a few times maybe 2 or 3 that one has gotten out. Like you I have a 6 ft privacy fence. It would break my heart because one incident of one getting out caused me to have to get rid of them.
