Now someone stole my picture and is using it on EBAY

With all due respect, this is inaccurate. You seem to be describing "fair use" law, which would not cover the kind of thing we're talking about here. And even "fair use" can be challenged, and has been successfully fought most of the time that it's been challenged.

hehe,,, ya dont need the "all due respect" with me

i dont mind being wrong and being told the "right",,

Photobucket specifically says they do not own anything you put on their site. From their terms of use:

Photobucket does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other materials (collectively, "Content") that you post on or through the Photobucket Services

They also consider it copyright infringement and have a report system and notifications setup just for people using your stuff:

For those who care it might be worth reading the terms of use concerning the differences between items set on private and public. It seems if you set your album or section with the stolen pics to private they can take more action should someone use your pics than if your album is set to public. Even though direct linking to a pic set under private works the same as when it's set to public.

It does sound kind of stuffy, huh? How about, "I'm about to disagree with you, but I don't want it to come across as if I don't like you?"

Plus, I'm sure I'm older than you.

HEY IDIOT!!! THE PICTURE WAS ON INTERNET AND NOT PROTECTED IN ANY WAY!!! SO I USED IT AS A PIC TO GET MY EGGS LISTED SINCE MY CAMERA COULD NOT BE FOUND!!! BACK OFF AND GO CRY SOMEWHERE ELSE!!!!

With all the respect due to a person of your venerable age and experience, "How many winking smilies does it take to screw in a lightbulb?".

I just reported that auction for using a "celebrity" photo of a well-known show bird that does not belong to the lister.

Can you actually do that? Cause I'm sure lots of people including me would jump in and report them if it worked. However I'm thinking that "celebrity" photos does not apply to our personal photos even if it is a show winner.

Hasnt ebay changed to where sellers cant leave feedback for buyers? Someone should bid on his eggs, then give him neg. feedback for misrepresenting his sales.
