I think I need to take one. I'll end up regretting it if I don't and want to add another later on down the road and can't find any. I'd like to have at least 2 with my silkies.


Just got back from dropping off the Magpies to LuvMyChicks. They seemed quite happy to be the only duckers over there. Home now, just made some eggs for a late breakfast for my daughter and I before we head out again, cracked open one of the double yolkers to use. I told her to check it out when I cracked it open to see how it had 2 yolks instead of just 1. When we sat down to eat I said "Mmmmm these are best the eggs ever!" Her response "Mom, that's because you used the double yolkers!!!" LOL

Off to go pick some apples...not sure which of the 6 orchards we should go to down the road! LOL Eeeny Meeeny Miny Moe Beak n Skiff, Oneils, McLusky, the Fayettville Apple Harvest building is open I saw, or Deer Run....Think I'll start small with her and go to O'Neils. I want fritters. Hoping someone else other than Deer Run has them. I wasn't happy with theirs although I've been used to getting my hometown's Apple Fritters are in the shape of Donut Holes, not donuts, for my entire life. There's a fritter booth we used to get them from at OUR local Apple Harvest Festival (How ironic is it that I end up moving to Upstate NY and living right down the road from another Apple Harvest Festival!) Ok off we go.

I came home from Country Max to find the Town of Manlius police parked in front of my house. Duane has to go. Apparently "several" of my neighbors complained about "noise at all hours of the night" from my rooster. I find it odd though that the cop who came said that the top brass on him want an answer today as to how soon I can get rid of him. It seems to me that it is the top brass somewhere who live near me that want my rooster gone because he is ruining their idea of suburbia. I have to get an answer to them today as to what my resolution will be to "avoid fines and court"

So, it wasn't enough that they were told there were no laws against me having a rooster, they have lied to the cops and are now saying that my rooster crows all night long. He is "waking people up before their alarms go off" and "keeping children up all night"

Funny, my mother in law who's window faces the coop sleep fine all night.

Seems as though these things are always one-sided. And I hate when people make up stories and exaggerate.
 
Well been busy around here reading a lot of books, if you can call that being busy. Skimmed through the 97 posts and seems everyone is having a good time and a lot of ya'll are doing stuff with apples. Sadly we don't do anything with apples. I thought of it when we first moved in we had 2 apple trees but I cut them down last year since all they did was drop to ground and get in way when cutting grass. They wasn't taken care of so they was big and dieing any ways.


Well I have 41 eggs in the bator yet again. I swear this is my last hatch of the year. I already found someone willing to take all I hatch I just wanted more hens from my leghorn X Ameraucana. I also wanted to try for a better hatch rate now that I know which hygrometer is correct.

My last hatch I lost 2 out of 13 after they hatched. One I think was the double yolker it kept pooing out weird stuff like the left over egg from when they hatch. other one I don think learned to drink or something it was ok one day that night dead. We have one tiny guy i helped out we call nemo. First few days he would get bumped or go to run and he would flap one wing to balance him self. I took him and put him in a small brooder for a few days with only 2 other chicks so he can get walking better and now he's running around fine. He's still small and cant jump/fly as good as others but we think he will make it.

Here are some pics of my first ee's. I ended up with 5 white chicks, 4 black, and 3 what i'm calling brown/barred not sure what they are lol.

Close up of the brown chicks wing feathers. A little blue kote under my thumb to mark this one. It's the one my mom liked to baby when she was up here she wants to know what it turns out to be. I think she hopes its a roo seeing she named it dinner lol.

Ok, so my property is zoned agriculture, I have been looking into getting my DBA and I'm going to the county to do that today (I should not have been putting it off!)

I don't know much about the laws but after reading that and seeing the Exception for "Sounds created by agricultural activities." I would say that you are in the clear. Also, if your zoned for agriculture and there are no rules/regulations that speak of owning a rooster, I would also say that you are in the clear. To me, "Agricultural Noise" means anything from animal noise to machinery noise to farm equipment noise. It's not like they state the exception is for "Agricultural Equipment" or something along those lines. IDK know what I would do. Is it easier to get rid of the rooster or go to court/town hall with these people? Do you have time for all that? LOL

Seeing you bring up the Manlius noise control issue and seeing that it states "Onondaga" county got me thinking. I've been so confused about this county for so long now that I finally JUST figured it out! And I see now why a while back Rancher brought this up to me when I had stated I was from "Syracuse" under my avatar. This whole time I thought that Syracuse was its own county and Onondaga was another. I did NOT realize that it's JUST Onondaga! LOL So Syracuse is just a city inside of Onondaga County?? You have to pardon my confusion to all this because I come from a state so small where we don't say what county we are from. We just say the town because everyone from CT knows where every town is. So there's no need for me to say I'm from "Hartford County", I just give them the town. I assumed that the major cities - Albany, Syracuse, Rochester, Buffalo were all their own Counties.

So Rancher, when you said that my area is actually in the Onondaga County, I thought it was because we were that further south from Syracuse that I was in another county. Didn't realize it covered Syracuse as well. Either way, when people (especially people from CT) ask me where we are living now, I still say Syracuse as in the area that I live in, because if I said anything else they'd say "Where's that?" LOL
 
Brella - it is a pick your battle type of thing .... how important is the roo to your long term plans and how much time and emotion do you have.

I am 90% sure you will win - but you may have to file an appeal - and spend a lot of time.

I am on the planning commission of my town - and I can tell you that if a handful of people show up on ANY side of ANY topic - they really hold some weight - so get some chicken people to back you up.

I would try to fight it. But also does agicultural have different types? like one set for live stock the other for growing plants? Not sure how the zoneing around you works.
Reading through this at section 86-4 paragraph C. you get "C. Sounds created by agricultural activities" which i would say you should be fine. Now how often does he crow and do you have a way of reading the noise lvl in and out side your house when he does.

Now it also looks like they could have an escape goat with 86-2
"UNNECESSARY NOISE
Any excessive or unusually loud sound or any sound which either annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of a reasonable person of normal sensibilities, or which causes injury to animal life or damage to property or business. Standards to be considered in determining whether unnecessary noise exists in a given situation include but are not limited to the following:
A. The intensity of the noise.
B. Whether the nature of the noise is usual or unusual.
C. Whether the origin of the noise is natural or unnatural.
D. The intensity of the background noise.
E. The proximity of the noise to sleeping facilities.
F. The nature and the zoning district of the area within which the noise emanates.
G. The time of the day or night the noise occurs.
H. The duration of the noise.
I. Whether the sound source is temporary.
J. Whether the noise is continuous or intermittent.
K. Whether alternate methods are available to achieve the objectives of the sound producing activity."

For A. they don't list what is accepted of the intensity of the noise ie what the decibel
needs to be to be intense
For B/C. you could say it's a natural/usual noise they could say chickens are not naturaly there so not a natural/usual noise.
For D. Is there a lot of road noise or anything in back ground where your rooster isn't that much louder at all?
For E. how close is coop to the neighbors house.
For F. I think you win this with the zoneing your in.
For G. they win for being a night time noise. If he truly goes off all hours of night wich i doubt seeing should be roosting
For H-J all depends on what your rooster does at night.
For K. they're alternate method is for you to get rid of him.

Now if you don't get to keep him and you are ****** and want to piss them off even more there is a clause in there that you can use to make other noise at night

86-4 B. Sounds created by snow blowers, chain saws and other domestic tools and equipment when used to clear driveways, streets or walkways during and after snowfalls, rainstorms, icestorms, windstorms or other similar emergencies.

That don't list times you can do it, and from what how it reads you can snowblow all night long during that snowstorm. Or plow with your rotating plow lights and back up beeper on.
