Ok....A whole new "off topic"....seems like the place for it...

I have a rental home on 5 acres with a barn. There has been a big "to do" over a fence the next door neighbors put in when I lived there. They wanted me to pay for half the fence. I was getting married and moving, had my pasture fenced in hot tape, which was working great (my saddle mule bulldozes thru fences). I told them I was moving in several months, didn't need the fence and didn't have the money to pay for a fence I didn't need. They were PO'd, but they said they would put their fence 1 ft inside their propperty line and I was not to use the fence. I agreed that that sounded reasonable.

Now I have renters in there. They had goats and a bull. We started getting calls from the neighbors that my tenants were using their fence. My husband called the renters and they told us that they had not attached anything to the fence, but they had constructed a fence up to the neighbor's fence. They said they would go tomorrow and buy more fencing and put in another fence insided our property line, to insure their animals did not get on their 1 foot of property or near their fence.

An hour later my renter called to tell us that the neighbors had come over to their side and pulled down their fence and let all their animals out. We told them to call the sherriff and report it. The neighbors were told that they cannot come on our property and take down fences or anything else.

I get a certified letter a few days ago telling me that since our tenants had not removed the fence "attached to their fence" they want me to pay for half the fence ($5K!) and yearly rent for the foot of their property on my side of the fence ($2500.).

Once again I jumped in the car and drove over to the property to look at my renters fence. It is not attached to their fence (never had been) and they have another fence running along side the neighbors fence using the exact same fence line that I used when I was there. It is 3 feet away from their fence and 2 feet inside my property line!

I have sent them a letter back stating this, also mentioning that the property line was a "best guess estimate" and they might want to get it professionaly surveyed. And btw...if the fence happens to be on my property. I will then require them to remove it and place it on their property.

I also sent them a document from the county that I recived from my title company and pertains to that whole area. This document states that it is wildlife migratory area and that wildlife proof fencing is prohibited around the entire perimiter of the property. You can fence your perimiter, but it specifies that only with 4 strands of barbwire and it goes so far as to say how high from the ground the bottom and top wire can be. The fence in question is 6ft no climb all the way around their five acres.

So yesterday, I get a call from my renter. Their goats and bull dropped dead on the same day! She has seen the neighbor hand feeding something to the bull, and the woman ran for the house when she realized she had been seen.

Basicly, they are being told that they need to get the animals autopsied(sp) to take any legal action. They don't have the money to do it, and even if they did, there is no way they are likely to prove that the poison came from the neighbors.

Anybody have any advice???

Oh goodness! I wish I had some good advice for you. All I can really come up with is to stay in touch with your local authorities (sheriff's office, animal control or humane society), keep all correspondence, and maybe suggest your to your renters that they invest in a wildlife cam, or even one of those video baby monitors from Walmart. They shouldn't be too expensive in comparison to loosing livestock. Heck, even a fake video camera strategically placed where the neighbors can see it may deter them from additional antics.

Her seeing the neighbor handfeed the bull is all the proof you will need in court! There is no reason a neighbor should be feeding your animals, not to mention after she feed them it died. Try to have the police get a warrent for a phone tap so they can record them talking on the phone also. The only way to get things done in America now is to goto the Courts or Use a gun (Then YOU will be in Court)! Take Video footage of the bull, post it on the internet! Contact Peta PLEAD for them to pay for a necropsy of the bull and goat (Make sure to say how horrible they suffered before they died). Make sure the PETA nutjobs know you want them brought to justice (PETA eats this crap up, at least they are good for something) Get a necropsy done on the bull or even the goat since the goat will be cheaper, contact a college to do it pro bono (For Free)if you can't get PETA to do it. The renters can sue them in small claims court for the cost of the bull and goat. I would contact the State and have them address the poisoning of livestock (FELONY) they will come in and investigate, the Feds might even come in. DO NOT DESTORY THE ANIMALS!

You have the right to put a fence up to theirs. Also if you are using the property WITHOUT their permission up to the gate after so many years depending on your State it becomes YOURS! Look up adverse possession and squatting rights on a search engine. Good reading for ANYONE who has property they do not goto for any length of time. I would contact an attorney and have the renters do so to. Don't sit on your hands you need to act now. If you call around you will find a lawyer who will do this for a cut of what you get. (Make sure you pay nothing if he does not win the case). Make sure to give us lots of updates

For all you Christians who think you are so right. Christ never judged people the way you do. That makes you UnChristian. Christ also never said anything about cussing, glad to see I am not wanted here because of my language. The vast majority of Christians are hippocrits now. Do you help people? Do you house or feed the homeless? Do you give your time to help the sick or dying? I am not saying do you donate to your church so they can build a new wing/temple or to a Non Profit that you then use as a tax write off.

Just ponder that for a minute before you blast me with your hatred. Jesus never Hated, remember that!

PSSS I feel for Southernchick to, she joked about how she likes to drink on the weekend. Most people here treat her as if shes/her hubby a backwoods hicks that pound hard liquor all day. (Choose your bad word). Truely sad because she is such a good person and goes out of her way to help people on this forum. btw Go look at the emergency forum, there are only a few names that try to respond to questions on there. I am one of them, she is also. I try to help people unlike the others who only offer negative comments. Look inside yourself and decide what you want to be before you have the gall to point fingers at someone else and gossip something about them!

Go to this site and find your state vet. Call and ask them where a free necropsy can be done. Often they are available free or low cost at Universities or thru ag extension state or county programs. In CA ours are done free thru the Univ of CA at Davis and several extension labs.
At the very least, make sure that blood and tissue samples are taken before the carcasses are disposed of.

Also, call the sheriff and the district attorney and tell them that the tenant witnessed the woman feeding the bull and then the bull and goats died. Insist that they investigate and press charges. Their labs can certainly test blood samples for arsenic, etc. It is unlikely that the woman is so sophisticated a killer that she would use something that is hard to detect. Also, suggest that your tenants bring a civil suit against the neighbors. You might also get some advice and support from a local ag or farmers association.

I just looked at your coop and that is awesome!!! I really like that you extended the roof to provide a covered area and that you have outside access to the nest boxes. When we build some new coops, Im hoping to also have a way to fill the feeders from outside the coops. It would make it a lot easier.

For your roosts, you could add a 2x4 above the current shelf and then the shelf would act as a droppings board. I havent tried using a droppings board but lots of folks use them and say they are easy to scrape off into a bucket and keep the coop cleaner.


Oh, I watched several episodes of Ice Road Truckers last night. Just watching them in that freezing weather, I had to keep getting up to get a warm cup of cappucino to take the chill off, lol, even though I had the AC on.
Is anyone watching the BBC series "Jeckyll"? Wow, that is a good show.

mdbucks, Opie and Anthony used to be up here in Worcester and they got in all sorts of trouble, daring folks to do things that they normally wouldn't....
I'm not big on the online multiplayer games...I like Myst and Riven and the Dig, and puzzle games...of course, I'm a POGO nut. I've been watching Jeopard since Don Pardo, I think. I'm so old that I remember when Game Shows ruled the afternoons and Jack Narz' Beat the Clock was on around supper time.
