Don't you really want the horse back, rather than a money judgement against someone who is probably judgement proof (because you won't be able to easily collect the money damages from him) Talk to another attorney that is licensed to practice in Oklahoma. Send me a PM if you need help finding one and I will do some asking around - but need to know the county where the lawsuit needs to be brought.
 
Hey fellow Okies ! Had a busy day today. Started the day before sunrise with a 30lb racoon in my trap. Now I have a new skin hanging in the chicken house.

I followed that up with the processing of my 1st rooster for an early Thanksgiving with the DD & GD. That was the best bird I've had in years.

The county is Cherokee County. I want the horse back. Why would they not award me the horse in small claims? The only other county involved is Rogers County where the contract was signed.

I have to bring the lawsuit into OK. All the transactions happened there. Why is he judgement proof? That is what I'm not understanding? All I'm wanting is the horse back, once that's taken care of, I can turn my attention back to the man who I leased the horse to.

There are limitations on what you can get in small claims court and I don't know those rules anymore. I do know that there is a dollar amount limit you can get in damages. I don't know whether small claims court has the jurisdiction (authority) to award you the horse. Even if the court awards you the horse, you are going to have to get more than just the piece of paper from the judge saying you can have the horse to get it collected from the man who has it - you really need an attorney who is familiar with this area of law..... to get the judgement and to collect the horse.

Have you gone to the District Attorney and asked to file charges for receiving stolen property against the guy who has your horse? Surely the value of the horse justifies felony charges.
 
Dachsunds - glad to hear all went well.

My father passed this afternoon. My family is grateful for the prayers. They were very touched to know folks all over Oklahoma and a few other places were praying for him and us. His wife and the youngest sibling are taking it very hard but will make it now that their lives can go on. He will be remembered. Thank you!
