Omaha, NE. I really want chickens:) but I have a deed restriction-covenant but no Hoa

I live in Omaha, Ne where it is legal to have chickens in the city with a permit. However Ive been reading comments about covenants and Hoa's. I want to abide by the law and get the permit, I do not have a HOA in this neighborhood however I just learned after living here for 10 years that I have a covenant attached to the deed. I never paid attention, nobody here follows it thats for sure. I guess what I'm wondering is if anyone has ever obtained a permit with a covenant that doesn't have an HOA, wondering if they dig deeper or if they only look for a HOA in a neighborhood. I really want just 3 hens.

If there is no HOA, there is nobody to enforce the covenant. If nobody complains, you're fine, and if somebody does, who do they complain to if you're meeting all laws and requirements beside the covenant?
 
your neighbors can enforce the deed restricitions by complaint to the city, there is no need to have an HOA to do the work for them. If your city has a nuisance abatement team, they will be the ones you hear from. Experienced this when I was growing up, our neighbors didnt like my dads hobby of working on cars. :)
 
Quick question ...does the restrictions limit chickens or livestock? I'm in an HOA, but no restriction on chickens ..so I can have them. Check yours, you can get the county (or city?) to give you a copy of the CCRs.
 
Unfortunately it does say-no livestock or poultry to be raised, bred or kept-but again nobody follows these covenants, I dont think the neighbors will care-just would really like to apply for the permit to make it legal, but afraid of them denying it:(
 
I would document which of your neighbors are breaking their restrictions. Just document and keep a copy somewhere. Then get your permit. Keep things clean, the noise down - and if anyone ever complains, show them how everyone else no longer abides by the Restrictions.
 
I live in Omaha and have 4 hens. I suppose I should think about getting a permit but after having chickens in my backyard for the last few years, I guess I haven't really thought about it since I haven't had any problems with my neighbors. They know that their barking dogs are a bigger nuisance than my 4 little hens in their enclosure.
 
Oh and I should add that the reason I started having my own little flock is that the neighbor across the street called the cops and the humane society on my next door neighbor because he had to chickens running around in his front yard. (He's from another country). Four cop cars and 2 humane society vans converged on his front yard one evening........the two hens walked out to greet them........they laughed and said "are these the "cock fighters" that your neighbor called us on? They just told them that they could keep them, just to keep them penned up and left. Never mentioned permits or anything like that.
