My City is conflicted. The City Code says I'll be legal. Zoning ordinances say I will be illegal. City Council has decided to take a do not ask do not tell attitude. So next year I will have chickens for the first time since 2000 when I lived in the country.

BigPeep: I also thought their verbage is a little vague. Even MORE 'interesting' is most of the people in the first 2 sections of our development were never given copies of the 'convenants' at closing or even PRIOR to building!!! These all 'materialized' afterwards thru the developer. (They're also available online...but not in paper).

Our neighborhood has the 'impression' with the folks in the area of being that 'rich snooty' neighborhood! Not even 50% of the lots have been sold, of that 40%ish, 40% are occupied...the other approximate 60% are in some varrying form of foreclosure! Oh and because less than 50% of the lots have been sold, the developer still holds the majority shares in the HOA...so our HOA has no REAL power of any kind.

The part about pet 'supervision' is REALLY stupid actually. I was told my cat is not allowed to be outside unless I'm with her...OH...and the ONLY fencing allowed is a 4 foot "open" picket fence (so spying is easier)!!! Dogs are not allowed to be out in your fenced in yard w/o a person supervising etc. (Really stupid stuff here). (no dog houses allowed outisde, NO kennels, dog runs, outter buildings etc). The white vinyl screen panel "run" (excuse me...enclosed garden bed) is not allowed. I'm starting to wonder if I"m allowed to burp outside or I'll be warned about that too!!! Now that I think of it, I'm surprised I haven't been arrested for gardening in scrubs and my sports bra...for INDECENCY!

Either way...I'm not too concerned, just the fact that we weren't provided with convenants at the time of closing...to me means guess what? You can't try to enforce rules AFTER THE FACT without WRITTEN NOTICE and a SIGNATURE acknowledging said notice!!! (We still pay our HOA fees...for services we do not receive and haven't in the 5 years we've lived here)...so IF they decide to "push"....I will DEFINITLY be PMing you AND other attorneys in our town to pursue the HOA and DEVELOPER for breach of contract and other various offenses on their part of the 'deal'!!! (And be damanding a refund of our fees until such time as services promised are delivered!)

I DO know a homeowner in our development challenged our developer on the "no RV" restriction in the convenants that didn't exist at the time he'd gone to closing...guess what? His RV is still sitting in his driveway and is LEGAL!
It's so funny, the developer planned the community to be the 'premiere/exclusive' blah blah blah...and overpriced it so the lots haven't sold since late '07. The builder has gone bankrupt (twice) and no ground has been broken in almost 2 years. We don't have a sales office and even the townhouse adds (we were NEVER informed townhomes were being planned for the development or we would've walked then!!!) haven't received any interest, yet townhouses are going up and being bought everywhere else!!! So we'll see if it becomes a problem....I doubt it though! (Especially since I'm only one of maybe 6 houses in our neighborhood that's actually bothered doing some really nice landscaping!)
I'm really proud of you holding on to your family farm and all. It's crazy all this development and farms being broken up and sold these days. When all the farms have turned into subdivisions....where will our food come from? China? I REALLY want to get a property in the 'country' or one that's at least zoned for agriculture. So I can get some goats and more chickens and some rabbits and MAYBE, just MAYBE a horse!

It's funny...off all us kids (raised in the suburbs) but with rancher family roots, I was always the biggest 'city slicker' of us all...LOVED visiting the family ranches....but now...all I want is to live on a farm and get AWAY from the suburbs!!! SOON....I'll just keep saving those pennies!

I'm legal. Not only that, but I found out today that I can keep my roosters. YAY! Also, though I searched for hours today, as far as I can tell, there is no limit on the numbers either. YAY again. I just can't let them run on public property or the neighbors property. No prob-lemO!
