Ok, she went and they set the date for sometime in February to go back and fight it.

She went to the Sheriff's department and they were no help. They told her the video she made wouldn't be any good because the sign could have been knocked over in the meantime. (Yeah, right.

)

Of COURSE they are going to say that. The video makes them look stupid. She should bring it to court anyway. What the judge thinks is relevant is not necessarily going to agree with what the idiot cop told you.

Good luck to her, remember that the police are our friends, and eggspect a MPH sign to appear on your street.

IDEA, as well as presenting a video, maybe you could get statement to the fact that there are no speed limit signs from some of the residents in your area. That may take away the "the sign could have fallen" arguement. It would REALLY be good if there is another officer of the law that lives in your neighborhood that could sign it. I dunno-I'm just sayin

If there has never been a sign on the road, go back and video the sides of the road/ditch on each side, then get something from the transportation department stating that the have not put speed limit signs in that area.

Dont forget to get statements from other people ho live on that road , that say that there was no or still is nosign stating the speed limit. Maybe you have someone who works for the goverment living on this road.

Cops just like to screw with people.
I remember the winter of 2005, I was driving home in a bronco we just bought with my baby in the backseat. There was no heat in that thing, so I was in a little bit of a hurry to get home from my parents who lived less than 5 miles away. I turned down a back road and had someone come flying up on my tail. I turned into my driveway and THEN the cop put his lights on. I got out of my car, handed my husband who was standing in the driveway my son and the cop came running up on me WITH A GUN. He charged me with evading arrest, speeding, yadda yadda yadda. I should have fought it. I paid $700 worth of tickets because he didn't turn his lights on while we were on a main road so I could SEE him.

Live and learn. Fight it. Hopefully she wins.

By the way, I was NOT speeding...
