In this country a restaurant has the right to refuse service to anyone.

I guess that that is exactly what the discussion is about--whether or not a restaurant DOES have a right to refuse service to anyone. Once upon a time there was a perceived right to refuse to serve based upon race...and gender...etc.

They would have a hard time proving discrimination. All the place has to say is she is welcome to come in without a child an drink. There not refusing to serve anyone of age for any reason. There refusing to serve someone that is under age.

Beings abortion is probably legal in the state that this occurred they would be hard pressed to prove ( in court) the fetus is / was a child under age. What she eats or drinks is none of the restaurants business she should sue them for discriminating against her, their stupid polices should be posted so before ordering a meal a decision can be made to leave . I would have made a scene and forced a manager to discipline the employee who was trying to force her / his beliefs on someone else

I did a paper years ago for a college class on Fetal Alcohol Syndrome.
The studies I read and used in my paper stated that a pregnant woman who drinks alcohol at an extreme amount will harm the fetus more then the woman who may drink just 1 alcoholic drink.

It is the right of that woman to make the decision for her and her childs own welfare. It is no one elses right to infringe upon that right.

With the litigious (you know what I mean) society we have . If she drinks that wine it could harm her baby and then she in turn could sue.

No one who loves their baby would risk fetal alcohol syndrome, IMO. Remember the ads, "mothers who smoke have babies who smoke". It the same with alcohol.

"I give you wine and your baby gets hurt and you sue, I get mad. I don't serve you alcohol you get mad. Better you get mad."

They don't have to prove a fetus is a under age child. They just have to prove they, themselves hold that belief. Then they have the right to refuse her.

Strong words ....... Totaly irrational alligation ... but strong stuff... A little red wine is said to be good. I'll find the BMA link (British Medical Assoc) if you wish. Our children are fine and my wife responsible and attentive ... non better. Certainly No alcoholic .... The next thing is you'll get all religious on me (Joke)...... Why should she even consider the idea of being "tea total" ?

That's true EXCEPT when the mother is older or has pre-existing liver damage so she cannot process the alcohol properly at which point even one drink or the occasional drink will go to the fetus almost untouched. You can see this very well in families like the ones I have adopted from where the birth mother has lost multiple children due to her inability to care for them. My son was the seventh child of 11 that are now in the system. He is severely affected but not as badly as the children who were born to this mother after he was. The same goes for my daughter who coincidentally was also the seventh child born to this mother. She has some severe affects compared to her bio brothers and sisters who were not affected as badly.
Sorry, I speak to fostering groups about FAS so I tend to get a little wordy.

Folks, this is a good discussion, but let's keep it civil. Some of you are getting a bit carried away...I understand it's a touchy topic, and we don't want to close it, as there is good information here. So....be mindful of your post. Thanks!

That's ridiculous, I guess you've never had a problem with addiction?

If it is a privately owned business....then yes they have the right to refuse service. There is plenty of legal wrangling over establishments that serve alcohol and where their responsibilities start and end. Bars and restaurants have been sued over folks getting too drunk and having accidents, serving to minors, etc. Because in our american society, it's easier and most common to blame others for our bad decisions, it is a business owner's duty to protect his business at all costs. If you are a business owner in a sue happy society you CYA - and if that means refusing to serve to a minor, a drunk or a pregnant woman, so be it. If you wanna get drunk, do it elsewhere.

Do I think the Gov't has the right to tell me what i can or can't eat? No I don't. I do not agree with cities who have banned certain cooking oils. Or who have passed laws saying I can't smoke in my car. Or schools who take milk out of the lunch room because some crack pot study says it makes kids fat.Or a zillion other laws that are passed to try and force people into common sense.

Further, I don't believe you can regulate, govern or force via law morality. You either have a sense of what is right and wrong or you don't. Clearly there are tons of mixed messages about what is good and what is bad especially when it comes to diet, exercise, drinking, etc. These "theories" from "experts" change quicker than most people change their socks.

That being said, there are babies being born with FAS, addicted to crack and other drugs, severe lung issues, low body weight, premature, etc that can be directly tied to what the mother put in her body during pregnancy. That is a fact. And it is also a fact that these preventable problems are a drain on society and public resources.

And since those resources come out of my taxes, then yes, I have a problem with it. I don't care what a person does in their life, as long as I don't have to pay for it. If your behavior effects my bottom dollar, yup I take issue.
