Rhode Island Red? Or production?

Two chickens have found my house and decided they wanted to live there after they were abandoned. I have no idea what kind of chicken one is but I believe the second one to be a Rhode Island Red? Also I think it's around 4 months old, not too sure but I know it's young. I have not yet seen them in person since the property is two hours away at my house that is under going renovation. These pictures are not great but is the RIR looking like a roo?

Nobody hopes for a rooster but, that's why most are dumped out.
Yeah unfortunately that's very true but these people got evicted and were just crappy. I don't think they even knew what they had. They are still very young so we're are still on fence if it's a rooster or not. With my luck it is. My only problem is I'm not sure if I'm legally allowed to have a rooster so I'm checking on that just to have a game plan if I can't keep him, if his a he.
