Roo instead of pullet?

I think my 8 week old easter egger may be a Roo instead of a pullet. I will have to get rid of him if so, we love in the city and have a neighbor who is suffering with cancer. He holds his tail feathers up high unlike the others. Thoughts and opinions?

Pink comb, three distinct rows, thick legs...I do believe that's a little boy.
