no animal fats? Wish someone would clue her in. I use animal OILS that are rendered from animal fat, but i no more use animal fat than someone who uses OO uses olives!

Seems like she's making claims on her labels also ... "Promotes a youthful complexion", "A natural Antiperspirant". Can't make claims like than on soaps ....

(yes, I'm a bit critical after seeing the 'animal fats'.)

Don't worry about the AO. I gave the run down on that one as soon as I read that. She didn't say no and said she was looking forward to the samples. I didn't take as good of a look as you did at the labels though. I do remember reading in many places that your not suppose to claim a soap can do something becomes then you have to deal with the FDA?
Am I right on that one? Should I say anything about that?
 
MLF - I agree.

It is dangerous to make claims like those. Then you become part of the comsemetic industry, FDA steps in and we are all going to suffer for it.
 
Absolutely CW. She can only state that soap will clean. She can only make claims if she has the soaps tested that they will perform the claims she is making.

Years ago, Blue Emu cream got into big trouble on this same thing.

And if she is relabeling them, she must state the name and contact information of who made the soaps on the label.

So I should email her and let her know these things? I did bring up the thing about the labels and she told me
"if we buy them outright from you, we would use our private labels."
Do you think I should conitinue this or just focus on my local shops?
I did register as a sole proprietor today.
 
If she makes claims and mislables the soaps and something happens and then she wants to point the finger of blame at you because you made the soap - is any potential profit you make from her worth the risk?
 
What she wants to do is private label, which is fine, but she needs to know your info must also be on there. After going to the site, and seeing the soap she has, I would be leary.
 
I've been bouncing all these same thoughts around with my DH espeacially after going to the site and reading that info about the soaps. Thats why I started posting about it on here. And no, any profit I make isn't worth getting in a legal mess. Perhaps I should just say thanks but no thanks on this one. I don't feel that she would go and change the way she has been labeling her soaps just so that I will sell mine to her. I'm sure she can find someone else to fill the spot that doesn't have such good friends as I do

Yes, she can buy them outright and private label them, but legally she is suppose to have who it is made by on the label.

If she doesn't, I don't believe you can get into trouble .... after all, your name isn't on the label. Even if she has a receipt that she bought abc & xyz soaps from you, no one can prove that the abc & xyz soaps she has her label on are yours.
