St.Charles Mi: Anti Chicken ordinance.

When I asked the village for a copy of their "No Chicken Ordinance" this is what they gave me..


Village Of St.Charles Michigan Zoning Ordinance

57. FARM. A tract of land which is directly devoted to agricultural purposes provided further that farms may be considered as including establishments operated as greenhouses, nurseries, chicken hatcheries, apiaries; but establishments keeping or operating fur bearing animals, riding or boarding stables, kennels, quarries or gravel or sand pits, shall not be considered farms hereunder, unless combined with bonafide farm operations on the same contiguous tract of land of not less than ten (10) acres.


If I read this right, I can have a hatchery and apiarie (I'll have to see the definition of apiarie)? If I raise my birds with the intent to sell chicks and eggs then I should be good. Right??

I do not have 10 acres though..

Wow. That's *really* poorly written. (Actually it's the punctuation that's the problem.)

I assume you are talking about your home on less than ten acres? I think you'll have a hard sell getting them to consider that a "farm".

However, what you posted just says what you *can* do on a farm. If chickens are truly not allowed, there should be a separate ordinance saying they are *not* allowed in certain places.

A quick look at Municode didn't turn up anything interesting. I'm in favor of, "That which is not expressly forbidden is permitted." :) Of course, it sounds like you already *asked* and they said no. You'll have to ask them how they're interpreting that section to prevent you from having chickens.

(BTW, the singular is 'apiary' -- think bee hives.)
