Which I like to know why the courts ignored the states on such a measure. It was illegally passed in the first place.

The signing of the National Defense Resources Preparedness executive order grants the Department of Homeland Security, the Department of Agriculture, the Department of Labor, the Department of Defense and other agencies complete control of all US resources, including the ability to seize, confiscate or re-delegate resources, materials, services, and facilities as deemed necessary or appropriate to promote the national defense as delegated by the following agencies:

This has been the case sense the Defense Production Act was signed in to law by President Truman back in 1950, probably before you were born. It gets changed some due to agencies change names and responsibility. The E.O. you are referring to is Executive Order 13603 and if you look up Executive Order 12919 you will find not much difference in the two and Executive Order 12919 was signed 1994 by President Clinton. With Executive Order 12773 that was signed in 1991 by President Bush was in relation to Defense Production Act that only ordered that section 303 of Executive Order No. 10480 is amended by deleting "Administrator of General Services" and inserting "Secretary of Defense" in lieu thereof and that section 604 of Executive Order No. 10480 is amended by deleting "General Services Administration" and inserting "Department of Defense" in lieu thereof and by deleting "Administrator of General Services" and inserting "Secretary of Defense".
Now Executive Order No. 10480 was the in 1953 when President Eisenhower first made changes to the implementation of the Defense Production Act.

So what's the big change from 1950 to now ? Nothing. Has it effected you in the last 60 years ? Have you been worrying about this all your life ?

During the civil "war" if the government needed your water do you think they didn't take it if the owner objected ?

Actually he amended the section allowing it in peacetime. Not just a state of national emergency. I knew this was already in place. ts the peacetime change that is dangerous.
 
The Defense Act cited here has actually been in effect since 1950. All that changed were some amendments. It was changed in 1975, 1984, and a couple of other times. Here is a link to the whole thing, should you choose to read it.

So, while Obama passed an executive order, giving himself emergency powers; it is the same act that every president since 1950 has operated under. So for the last 63 years, this has been in play, yet I haven't seen all the dire things predicted. And just as an example, only males of a certain age register with selective service. They do not ask you to follow up after you age out, and they do not ask that you tell them your profession.
 
Yup I have read the whole thing. I was referring to the amendment, and the letter from the white house stated what they were. As I stated in oth posts the problem was peacetime declaration of Martial Law as in He or any president thereafter can declare it upon will.

What part of the Defense Production Act refers to war time only ?
 
I am not trying to argue anything, jus pointing it out. They listed the changes, it was highlighted in the article back in March 2012.

I'd like to see the section that defines clearly in B&W what it's defined as. Like an addendum perhaps? State of national Emergency VS. Peacetime and so on.

When does a national emergency effect all 50 states ?
Cant there be a regional national emergency ?
Would it be a national emergency if the Gulf Coast oil refineries were all knocked out for a few months ?
Would a asteroid hitting the East coast be a national emergency ?
