first of all MALICE has nothing to do with roosters or noise; malice is what a murder suspect gets charged with when its found that you murdered someone with viscious and mean intent; it only applies to what your emotional intent was when killing someone in new york state; and if you mean menacing that also has nothing to do with roosters or poultry ordinances. thats penal code 120.15 and only applies to threatening serious bodily harm or death while presenting a weapon or following some one around threatening bodily harm with a weapon over a course of time. you are obviously not in court for a rooster crowing. for menacing you would be arrested(handcuffs and all) and processed; and malice is what your intent was when killing someone. there should not be a mention of poultry when addressing those criminal offense charges as it has totally nothing to do with your flock!! you say your neighbor caused all these agencies to show up at your door constantly over time???? thats aggravated harrassment penal code 240.30!!! how many times were you bothered??
