The Neighbors Dog

Thanks for all the replies. Let me clear up a few things. The dog was only kenneled here on Mondays (this is when the homeowner is in town and stays at the house with her tenant), permission for the dog to be here has been revoked, Let me be clear about the arrangement, the dogs owner has access to our yard thru a side gate, she was coming in 2-3 times monday evening to walk her dog and care for her, We had no responsibility for the dog whatsoever, she merely slept in her crate on the porch, the dog does not stay here and the owner has been fully responsible for her dog, including putting her in the crate and securing the crate and removing the dog and crate on Tuesday mornings.

Like I said previously, this was done with my wife overriding my opinion, which was from the beginning, her dog is not my problem, NO!

I think my wife has learned her lesson, and she clearly understands me when I say NO animals will ever be allowed on my property again, unless they belong to us.

Thanks for the advice on splinting the legs and taping the wing, will do asap.

The dogs owner has offered to replace my birds, so I will wait and see if she does.

Good for her....If I was you, I would pick out the birds and just let he know how much....if she is not a chicken owner, god only knows what you would get.

Please don't blame all pit bull dogs just because you had a bad one. We have had Mia for 10 years and she thinks she is as small as our yorkie. Do I leave her outside with the chickens free ranging? yes I do, she watches over Myself, My dh, him esp since he is 72 and almost deaf. and we do have a lot of rattle snakes, Not to hijack the thread but, IMO you took the dog, knowing the breed but not the dog, so sorry i think its your loss. not the neighbors. marrie

Ok, if the dog owner was the one putting the dog in the crate, securing it, and keeping the dog there until said dog owner came and got the dog, then I believe that she is responsible for this unfortunate event. Having her do all the work changes things a bit. From your first post, it looked like you were responsible for locking up the dog, which would have made you the only responsbible party. Having her do all the management, makes her reponsible when the management of the dog gets mismanaged for whatever reason. So she should pay for the chickens, which she agreed to do. And I believe that's the extent of her responsibility in this one time event. I agree that you should get the chickens and present her with the bill.

While I firmly believe in SSS, I do believe that since you gave her permission to keep the dog on your property on mondays, that you can't SSS (I know you didn't do this, but some people suggested it). When you give a person permission to house their dog on your property, a risk you take is having them get out and cause damage. That's just the way it is, dogs sometimes get out. If you hadn't given her permission, then SSS would be an option, but you (or your wife) did give her permission and took that risk. The dog was on your property with your permission (even though it was supposed to be crated).

What I would do in the future, is tell her she has to find some other arrangement and that her dog is not allowed on your property at all, under any circumstances and that it will be shot on sight if you see it on your property. This of course, is only if you're allowed to do so. I would also put it in writing so that if she dog does get out (which is likely), that you can take proper action and have documentation to back it up. If she cares about her dog (which, for me, sounds like she does care) she will make sure he won't get out.

I'm sorry for your loss. It was nice of you and your wife to allow her to work out this arrangement. But it didn't work out, whether she neglected to properly secure the crate or the dog performed a houdini. She just has to find another way to contain her dog.

I still don't get why the dog couldn't be crated at her place, even with the dog crated outside and away from the home owner. But that's her problem unfortunately.

My guess is that the homeowner's insurance company would raise the premium rates through the roof (or just cancel it altogether) if they discovered a pitbull resided on the property.

I have a friend who rehabs Rotts and he has a devil of a time finding someone to insure his home for a reasonable price.

Or maybe not... since you shot their dog. lol That probably evens things out right there.

(Still not 100% sure that's the case, but I've read your post 3 times and I think that's what you mean.)

I think this is a little more than accusatory & that perhaps a apology is in order especially since this person is so upset after having lost so many birds & has had to put some down....

Yeah, I totally misread that. I hope I haven't offended the OP but if I have, I completely apologize.

No feelings have been hurt, I was really upset at the loss of my birds. I personally do not like dogs, but my wife loves all animals, the birds were my idea and my pets...lol, i bought them as food.

Just so you won't wonder why the dog has to be away from the house on Mondays...

The house is active on the market, it is being shown on average 3-5 times per week, the owners are helping a woman from their church by letting her stay in the home while it is on the market, they have relocated to another town an hour away, one of the homeowners still has a job here and works there on Monday (the homeowners are both Dr.'s) She is 8 months prego and stays in the house with the tenant on Monday so she won't have to drive the hour home after working all day. They do not want any animal in their home because they want it to sell, but the tenant has her dog anyway and is hiding the dog on Monday. While I do not condone her behavior, it is really none of my business. The Realtor knows of the dog as well, and I am sure he would tell if he felt it was necessary.

Again thanks for all the replies....

TC

Well, how sweet of the tenant/charity-case..

I wouldn't expect a nickel's worth of repayment from this one...

And...forgive me, but...why does it seem like there's some kind of an irresistable magnetism between pitbulls and irresponsible people of little to no means?

I'm certainly not saying all pitbull owners are this way...but, c'mon...doesn't it seem like a disproportionate number of pitbulls belong to people who truly shouldn't be trusted with a hamster?
