Sorry I wasn't clear. I think I would have talked to him and if I saw him doing it again a different day, take it to the manager. And I wouldn't tell him he should be working instead of being glued to his phone (even though that is true), I'd ask him if whatever was on the phone was more important than his life since he just missed hitting or being hit by a car. What if the driver was similarly uninvolved with what s/he is SUPPOSED to be doing (driving) and didn't see the oblivious kid in front of him/her?
 
Personally I hate telephones. My son got me a cell phone so he could always get in touch with me. It never leaves the house but, I got him to put some of my favorite songs on it. I only use the phone to hear them play. He even fixed it so the ring tone is
"Take on Me," by Aha.

But honestly when phones ring -it scares the carp out of me. I'm usually deep in thought, and don't need noisy reality butting in. I do check it for the date because I never know what that it. Every day is pretty much the same (when you aren't working) so it is hard to tell.

Ahh okay, that makes sense. I probably should have talked to him instead of just watching but I didn’t really think to at the time. If I see him again I definitely will though.

Yes, I work from home. AC is great until it's time to mow or feed and water everyone.
