I went over the paperwork again and carefully checked the wording. (BTW he does list a proper SSN for himself but not one for his wife)
It states (in so many words) that the appliances and extras are a part of the house and property and are not to be removed unless for repair or to be replaced by a similar object of equal or greater value. .... At which point should the buyer foreclose or fail to fulfill the contract he is held accountable for any damages or loss of property within a substantial amount as deemed by the seller.
I sware ive read these papers a zillion times and everytime I catch something I should have worded better, but nonetheless the terms of the owner financing contract were clear. The contract was never fulfilled and the deed was never transferred.
I'm sorry to hear such horrible things happened to all of you! I guess I should be glad there is any house left at all! A sledgehammer... such horrible people...
My dad had a similar circumstance with a house he was buying in the next town over. I was only in HS back then and didn"t draw the contract for that one (if there even was one). He was asking for it on that house though. It was beautiful! Even nicer than that one, with a sunken living room, fireplace, stone kitchen walls with built in shelves, all hardwood floors, old english style bathroom... just beautiful!
We were living in it with his girlfriend and her 4 kids. When they split we moved out and he let her stay under a renters agreement (yea, tell me that wasn't bound for disaster!). When he finally evicted her and we went to assess the damages it was in an even worse state than this house! they had obviously let animals live in there without much care for them. The carpets were so pee stained (Im sure some of it was human) you would have thought the original color was yellow! The walls looked as though they had been stabbed over and over (probably with an axe, I guess they didnt have a sledgehammer). We couldn't stay long because we were being attacked by hundreds of fleas. On the ride home we had to pull over on the highway, get out of the car and roll in the dirt because so many fleas had gotten on us and were just biting like crazy (id rather roll in the dirt on the side of the road then bring that home to my dogs!) So much damage it was cheaper for my dad to just let the house go and foreclose on it than to try and fix it up again.
Makes me kinda think of that show Repo Man. LOL!
