The following is not hear-say, it is fact and we have this done at least once a year. We also have our birds tested for avian influenza.
In the state of Texas, there is a law that all sellers of poultry/fowl has to keep a record of name and address of every person that has purchased birds for 2 years. Also, they must be Pullorum-Typhoid tested clean.
This is 18 Tex Reg 7922 Section162.10 and subject to penalties under section 162.7
This law has been in effect for at least 4 years that I know of for sure.
Right now each state has the choice as to whether they want to participate in this NAIS preliminary step. Texas NAIS supporters just happened to slip this one by without much fuss, attached to another bill.
Once we found out about it, we have been fighting to make sure it doesn't get taken to the next level.
There is way too much to go into on a forum, but that is not the only law concerning birds in Texas.
That one is regulated by USDA, there are more laws that have passed under The Texas Animal Health Commission's juridiction, which required anyone who sells birds anywhere other than at their residence has to pay a fee for a permit that is called "Certificate of Registration Domestic & Exotic Fowl". The fees range from $25.00 to $700.00 a year depending on how many birds you have and what your classification is, (seller, distributor, transporter).
A TAHC inspector comes to your house before this permit is issued each year to verify the number of birds that you have listed on your application.
You have to have both the P/T clean test and the permit in order to sell chickens anyplace in Texas except for your residence/property.
Also, feed stores, TSC's and such can buy chicks from an NPIP approved hatchery and not be required to purchase the permit, but if they buy chicks from an individual or let an individual that is not NPIP approved, sell chicks on their property (the stores), have to purchase the permit from TAHC. That is why the feed stores that know this only buy chicks from hatcheries.
