Trouble with the neighbor.

I like the way you think..

hahaha I'm SURE I'd get a police noise citation for that.....

But I do already have a metal garden decoration rooster and a big stereo

or can you imagine the look on the cops face when he calls back and says the rooster is crowing again and you show them your rooster

There are others just a few blocks from here that have roosters

Just because animal control says you have to get rid of your chickens it does not mean you have to get rid of your chickens. Methinks they are overstepping their authority. Since they are harping about the noise, find out exactly what the allowable noise level in decibles (sp) is. Then document your noise level. You can buy or rent a meter. I don't think they are that expensive. Then get a copy of the regulations on coop placement. Once you have that you can see what to do next.

There is no way in H I would let anyone tell me I have to get rid of my chickens. I would make his life miserable. I wouldnt just blare a rooster crowing at 559. Id do it all night long. And all day. 24/7. Muhahahaha!!! I would do what everyone else said to do as far as the police report and tell them you have complained about HIM threatening to shoot your birds and that he has come onto your property illegaly and threatened you also. I would make this so much of a pain in the butt for him he will wish he kept his mouth shut. Get the meter. Find out what the legal levels are and get a lawyer to write him a nice letter threatening to take him to court for harrassment, trespassing, and whatever else you can think of and show him you have bigger guns than he does.

I agree.

The note says: "The department has received a complaint with reference to your dog or dogs. The violation is listed below and we would appreciate having the situation corrected to eliminated the need for further action" (emphesis mine) He circled "Disturbing Noise" and put his name/the date, etc. and then hand wrote "You must get rid of chickens you have 3 days to do so"

Aint that the million dollar question!

The temporary idea is to move the bachelor pad (it is 2 cattle panels and some T posts with a deer net cover) to my in-law's land. The roos are about 16 weeks on the 19th of this month, I had slotted freezer camp the last week of July or first week of August. Not sure about the girls.

In effect, if I move them, the bad guy wins

I wouldnt move those birds... Maybe the roos... but not the hens.
And you NEED to file harrasment charges... get a restraining order on the guy..
You DO have enough proof..he threatend a gun and was again seen on your property with a camera....
If you do that..then he WONT win...

I understand that the control officer was using a form but the fact that the form says dog/dogs and the animal causing the noise was a chicken leads me to believe that there is no way to file a complaint legally about the chicken noise with animal control. See if you can find the local statutes or municipal codes on this. I think there are a lot of times people just believe what an "officer" tells them without checking into it. Had some problems with a neighbor in the past with dogs barking and just because he was a cop he thought he was right. I looked up the statutes for public nuisance and there was nothing in there about barking dogs. It is worth finding out what the laws are to find out if you have actually "broken" one. Good luck

Hmmm, okay, the coop placement is the problem? Then remove them from the coop and place them in a movable tractor. I don't recall how many birds you have, but a PVC and chicken wire tractor can be bult pretty cheaply, of get a large wire dog crate and cover with shade cloth.

Also, get written permission from the neighbors who like your birds for them to be placed closer than 50 ft. And check to see whether the 50' is from the property line or their house or even their sleeping quarters. I've all three used in different codes I've read.

Can you post the exact code, or a link to it?
