Uncontrolable Dog

The worst thing happened to me last year with my sex-links. I saw the dog chasing my birds, but i didn't manage catch the dog. I decided to fix the fence and pray it didn't get back in. Well, i was good until one night (about a year later) my grandparents came for a visit and didn't close the gate.
The overly persistent dog got in and killed 2 of my ducks (the chickens had gone to bed).

When i asked my neighbor he claimed it wasn't his dog. (he feeds it and it only comes to him but 'it isn't his dog)

He refused to pay me anything.
Animal Control told me that unless i actually stood there and watched the dog kill it there was no proof that that dog had done the evil deed. I'm against shooting dogs, but if no one will take responsibility for the brute and animal control won't take it, what do i do?

Our local animal control officer is one of my egg customers. We asked about the new leash law and he gave us a copy of our county's new animal control ordinance laws.

It states that " Owner/Custodian shall mean any person, firm, or corporation who has right or property in an animal or who harbors an animal or allows an animal to remain about his premises for a period of at least four (4) consecutive days."

" Harboring shall mean the act of keeping and caring for an animal or of providing a premise to which the animal returns for food, shelter, or care for a period of four (4) consecutive days."

So, here, if the dog stays around his place for 4 days in a row, it belongs to him and he is responsible for it.

It also states: "If an owner, custodian, keeper, or person in control of a pet animal knowingly allows the pet animal to run at large, worry or kill domestic animals, fowl, or livestock, he/she will be subject to a fine not to exceed $500.00."

You might want to check your local laws. These are just our county animal control ordinance, their are stiffer laws about dogs killing livestock that the Sheriff's Dept handles.

Lock away your birds, lure it into your yard and then have animal control come take it away.

Or have your neighbor catch it, and then call animal control.

Bait a live trap and call the cops.

It may be his responaibility to control the dog, but it's your responsibility to protect your hens. I wish that a fenced yard was enough, but sadly, it isn't.

I've talked with my neighbors and it turns out the same dog has gotten some of their birds too. We've all talked with animal control and received a long line of BS. I'm going to read up on our laws and see what else i can do. Luckily, it appears the man is moving and taking this dog with him.

I'd still like compensation for my loses, but i don't see that happening. At least if i know more of the laws i won't have this problem again. *fingers crossed*
