Eggcited, I know exactly what you are talking about in your last post. That happens here too. As for the survey, my parents had their land surveyed and the surveyor did not mark the boundaries. Apparently, when questioned, here in WV, there is an extra charge to have the boundaries marked. He just told mom and dad what trees and so on...Soooo, mom and I went to the courthouse and got the survey maps from the last 2 surveys, and, with the one that was just done, compared all the surveys and then took a can of bright orange can of spray paint, and walked the boundaries and marked them ourselves. We double checked, triple checked to make sure we were marking correctly. The realtor told you the property was just surveyed. Go to the courthouse and get a copy of the survey. If you are physically able, walk the boundaries. Look for the markers and take a can of paint with you. It also helps to have a 100' measuring tape. If it was just surveyed, there is no reason to have it done again. As for him wanting the road to be moved. My children's grandmother in TN had the issue with a neighbor using her driveway behind her house as a way to get to his house, even though the main road was in front of the house. She tried to block it and the city told her there was nothing she could do. It had been used as a "driveway" for over 20 years and therefore it was considered a driveway. You need to contact your town officials (or if your town is not incorporated, go to the county seat) and see what they say about the road. Roads are surveyed every so many years. I believe in your first post you said it was gravel. So if the county or the state is still maintaining the road by adding gravel to it, the road was surveyed. I would advise researching the mess outta this. You can do a lot without an attorney. Besides, if your town is like this area where I live, the attorney's are in the rich guy's pocket. Btw: I was not born and raised here. I moved here almost 10 years ago from a big city. Yet my family and I are looked down upon because we to not bow to the ones here that think they are above everyone else. They found out quick that we can think for ourselves. I was sitting on mom and dad's front porch one day not long after we all finally got moved and one of them had the nerve to come over and try to tell us who to be friends with and who not. One lady in the community was in her 70's, saw her walking up and down her road almost every day. From the first day we moved in, she would wave at us when she got to the end of the road and turned around to go back. On the day this "person" came up to tell us who to befriend, she reached the end of the road, threw up her hand, and we all (minus the high faluting person) threw ours back up at her. This person turned around to see who we were waving at and then proceeded to tell us not to associate with her, that she had words with this person's mother and she was a mean old witch that hated everyone. Then he said the wrong thing. He said that he couldn't wait for the old *itch to die and we had better not be caught talking to her or anyone from her family or things would get bad for us in a hurry. Dad just politely got up, walked inside, got his pump shotgun, loaded it, came back out, pointed it at the idiot and told him to step off the property. If he set so much as a finger back onto the property, he would be shot. Dude didn't believe Dad. He did after Dad put a hole in the porch. I have never seen anyone move so fast. They haven't bothered us since.
