When someone said it was just surveyed, you say where are the markers. They should be easy to find.

The new guys not at fault, I don't care where their from. All they want is what they payed for, is that only a rich bully and city people thing ? Try walking across the road and looking at it from their point of view.

I agree with this. If it was truly just surveyed, the markers wouldn't have been buried. I'm sorry that the realtor lied to you.
There is the hope that you can take this to court and argue for adverse possession, grandfathered usage, squatter's rights, whatever your local zoning may call it. There will be legal fees and it's possible that you will have to pay the new neighbor for the property that you are taking.

But, I'm with Hemet. If you bought 3 acres of property and planned to build and then learned that .5 acres was being used as a road that is actually supposed to be 30 feet in the opposite direction, wouldn't you be upset? I know that I would be. Or that the neighbor's fence was 5 feet onto your property line? Wouldn't you want it to be moved? It's only a matter of scale.
I don't think that it makes him a bully. Or someone who wants to show off for his city friends. That attitude only serves to make YOU look bad.
 
The rich guy does not use the road. To get to his mansion, the road is not even used. To get to his home and play buildings (no man cave, man building and other buildings to party) the road to all those are from main street of town. His land does butt up against this road. The land (300 + acres) that is up against the road is rented out for pasture for about 50 cows. There are two gates off of the road to access the pasture, but it is used twice a year - once to turn the cattle loose on the land and once to load up the cattle and take to market.

The rich guy is not new to the town. He grew up here and many people feel he has a chip on his shoulder towards 'lesser' people of the town. His dad died this past year and left the money to the rich guy. Now that he has money, he wants to "show" the town.

One of the neighbors is the 'city' person who is kissing up so he can be important and build his 'big fish in a small pond' status.

The land that is being talking about is all land that had been coal mined, open pit. The coal mine had to fill in the huge stripped ground mines. The coal company left the area about 30 years or more ago. They got tired of paying taxes on the land and turned it over to the state. The state then turned it over to an agency to sell off the reclaimed land. People were able to buy the land very cheap. The 300+ acres was purchased by someone who built a mansion and party buildings. They rented out the back part of the land to someone who runs cattle on it each summer. The people who owned it divorced and the divorce was so costly that they then sold it. The rich guy who recently inherited dad's money, purchased it.

During all the time of the land belonging to the coal mine, the state owning it, purchased by the first guy who built the mansion (which is accessible from main street of town and no one uses the road to get to the mansion), and now the rich guy purchased it--- during all that time, no one complained where the road was and continued to use it exactly where it is and has been for at least 30 years (but more likely it is closer to 40 years or maybe more). Everyone accepted it as the road and never questioned using it or moving it.

There are other people who live on the road and they use the road daily to get to their homes, and to town or whatever. It is also used to get from one road to another road.

Something I have forgotten to mention in all this: I am talking about small town living that I and all others in this area of the state have lived all our lives. Small town meaning general average population of 1000 people, maybe as much as 1,500. Rural meaning, towns are 15-20 miles apart or even further.

And if you have not grown up in a rural small town life like this, you have not experienced the small town hierarchy. The common interaction of the 'haves' and 'have nots'. It is something that can not be described nor explained. It is something you had to grow up with. Every small town person from this section of the state knows it (if they grew up with it and did not move here from someplace that does not have this).

When I say 'haves', I am talking about the people who grew up very well off and don't know what it is to work hard, very hard, for what they have. But it is not just that; it is the ones who grew up that way and beat down those they consider not in their status. Not as good as they are (in their minds of their own special status) Not all people who grow up with money and have never known money problems are snobs, and treat others as lesser beings. But sadly you do get ones who do see less money people as lower class and beneath them.

That is the reality of small town hierarchy and politics in this area of the state. It encompasses several counties, not just towns.

The 300+ acres are not being used for crops. So no lost crops from the additional acreage that would be gotten by moving the road. The 50 cattle grazing on the grass will not be damaged in any way nor will they not have enough food.

The mansion has it's entry road, driveway from main street of town. And that is the fastest and closest way to get to the mansion. (I keep refering to it as mansion, because it is not for just living. It and the additional buildings are for showing off the person's status. When their friends come over or a party is held, the home and all that goes with it are for show purposes. To show status) The 300+ acres, mansion, etc are so that the owner can take people around the land and show off his 'estate'.

So lets see: 300+ acres would gain an acre or two maybe as much as 3 (but not for growing crops nor needed food for the cattle) by moving the road. While the 5 acre home will loose 50 feet wide and 150 feet long of what they were told is their land.

Eggcited, I know exactly what you are talking about in your last post. That happens here too. As for the survey, my parents had their land surveyed and the surveyor did not mark the boundaries. Apparently, when questioned, here in WV, there is an extra charge to have the boundaries marked. He just told mom and dad what trees and so on...Soooo, mom and I went to the courthouse and got the survey maps from the last 2 surveys, and, with the one that was just done, compared all the surveys and then took a can of bright orange can of spray paint, and walked the boundaries and marked them ourselves. We double checked, triple checked to make sure we were marking correctly. The realtor told you the property was just surveyed. Go to the courthouse and get a copy of the survey. If you are physically able, walk the boundaries. Look for the markers and take a can of paint with you. It also helps to have a 100' measuring tape. If it was just surveyed, there is no reason to have it done again. As for him wanting the road to be moved. My children's grandmother in TN had the issue with a neighbor using her driveway behind her house as a way to get to his house, even though the main road was in front of the house. She tried to block it and the city told her there was nothing she could do. It had been used as a "driveway" for over 20 years and therefore it was considered a driveway. You need to contact your town officials (or if your town is not incorporated, go to the county seat) and see what they say about the road. Roads are surveyed every so many years. I believe in your first post you said it was gravel. So if the county or the state is still maintaining the road by adding gravel to it, the road was surveyed. I would advise researching the mess outta this. You can do a lot without an attorney. Besides, if your town is like this area where I live, the attorney's are in the rich guy's pocket. Btw: I was not born and raised here. I moved here almost 10 years ago from a big city. Yet my family and I are looked down upon because we to not bow to the ones here that think they are above everyone else. They found out quick that we can think for ourselves. I was sitting on mom and dad's front porch one day not long after we all finally got moved and one of them had the nerve to come over and try to tell us who to be friends with and who not. One lady in the community was in her 70's, saw her walking up and down her road almost every day. From the first day we moved in, she would wave at us when she got to the end of the road and turned around to go back. On the day this "person" came up to tell us who to befriend, she reached the end of the road, threw up her hand, and we all (minus the high faluting person) threw ours back up at her. This person turned around to see who we were waving at and then proceeded to tell us not to associate with her, that she had words with this person's mother and she was a mean old witch that hated everyone. Then he said the wrong thing. He said that he couldn't wait for the old *itch to die and we had better not be caught talking to her or anyone from her family or things would get bad for us in a hurry. Dad just politely got up, walked inside, got his pump shotgun, loaded it, came back out, pointed it at the idiot and told him to step off the property. If he set so much as a finger back onto the property, he would be shot. Dude didn't believe Dad. He did after Dad put a hole in the porch. I have never seen anyone move so fast. They haven't bothered us since.

A guy who used to have a national radio show I listened to gave general advice about buying and selling property such as acreage and homes quite often he asked callers all the time who is the Realtor working for? the correct answer was always the seller, even if you walked into an office and they showed you a property listed by a different company because he or she makes a buck when you buy something, not one second before, he also told people to hire a real estate attorney and have the land surveyed and staked, and also hire your own home inspector to inspect, because if they hired one it could be the seller's B-I-L and he could not disclose some stuff and claim he never saw it or it happened after you bought it. caveat emptor, let the buyer beware, I'm sorry this happened to you but hopefully someone will read this thread and not end up in your shoes.....
 
I'm not to sure about American law, In Canada, it would be squatters rights. (my nieghbor asked her lawyer cause of something simalr)

What I wanted to comment on in rural living, were not quite a rural as you, I can see my neighbors houses. When we first moved here from the city, we had people tell us whom to be friends with. And who's not a friend. The one family, they said not to be friends with, an older couple. They are our closest nieghors, they would do anything for us, we do anything for them. The other ones, not so much..

Funny how people are..
