Actually, it is you who can sue. There is a HUGE precedent of state statutes protecting livestock against this very thing - generally outlining dogs specifically, but certainly a cat may be listed as a predator, and it is FULLY within your right to protect your livestock from any predator that comes onto your property at any time. At the VERY least, I would call animal control. They can trap the cat so the owner will have some checkbook therapy for one, and a little proper education about the laws of your state for two.

http://www.animallaw.info/statutes/ This is a great resource for you. It will have all of your state laws regarding this sort of thing, and has a great search engine to find what you need to hand to your neighbor...

I understand about feeling badly killing a cat - you are fully in your right to do so - I can't believe the neighbor responded with a statement of suit rather than keeping her cat home. Take it to Animal Control if you have a terrible taste in your mouth about shooting it.

I just LOVE these stories of paintballs though - they're non lethal and send a poignant message. Great imagination!

Good Luck, and I hope your chick is alright!

Around here, there is no requirement for cat owners to keep their pets under control. Hower cat owners who let their cats run the risk of them getting run over, or killed by dogs and other predators. I would say she is lucky to have the cat back.

Unfortunately birds often die shortly after being caught by a cat due to infection. I think it would be a good idea for you to take the chick to a vet for whatever care thay can provide.

Hopefully the neighbor will cool off and at least be civil in the future.

Have you ever heard the expression "herding cats"? Well, you will fight a losing battle with the cats since they are without boundaries. The paintball gun may have served to scare the one cat away but there will probably be more.
I have a mean rooster if you are interested...His name is Buddy Blackheart.

Yup.

I hope you know what the laws are in your area, though, since you have informed the cat's owner you will shoot it.

There is right, and then there is legal. Sorry, they don't always match.

I wholeheartedly agree with everyone else. The cat must go. I wouldn't waste time on taking it to the pound, there are too many cats there as it is. Cats are one of the worse predators out there. In most cities they are allowed to roam free, they kill more song birds than any other source. I don't even have barn cats now for that very reason, and I do like cats. Ones that stay in the house, and don't terrorize birds. We have way more wild birds at our feeders now that we are catless, and even have a small screech owl in the barn. Yes, but little screech doesn't bother big chickens, so far. We keep all the little ones confined tight. I'm glad I don't have a neighbor like Mrs. Cat Lady. Soon to be Mrs. Catless Lady.
