YO GEORGIANS! :)

Just today our neighbor (he owned our land in 1997) notified us that in a deed that he and his wife made, it states that there shall be no hogs, chickens, turkeys, or guineas on the land for 60 years or until he changes the deed. This deed was made in summer of 1997. Don't know what to do. Is there anything to do? Do you have any ideas? Another thing is that I just got 22 chicks on the 15th of April so they are one and one half weeks old today. Plus I have 7 hens and a rooster. AND, I have three hogs!

What on earth kind of thing is that to put in a will? Is that even normal??

Was that information made available prior to you purchasing the land? If it was not part of the sales contract paperwork (disclosed information, etc.) I don't see how there is thing one that they can do about it.

I'm not sure if it was made available or not. They sold the land in 2006(not sure on the date) to a different owner who lost it to the bank in 2010. We bought it from the bank in 2012. He's coming over to talk about it later this evening; I guess we'll see what proof, etc. he has.

I wouldn't be too worried about it yet. A lot of those kinds of things end up being unenforceable. But of course the first step is to see what he has. Hope it works in your favor.

The big thing in his favor is that he is an attorney. I'm sure he has lots of official documents.

But even attorneys can make mistakes ... and errors in filings at subsequent sales have been known to nullify previous covenants. Certainly not saying there is nothing to worry about but I wouldn't worry until it is actually time to worry.
