Although is allways harder to tell from pics, they both look like pulletts to us. Combs would usually be more red on males at 12 weeks. The cushion feathers would be more pointed on males. The body shape looks female, as do the tails.

The legs on the splash look good. Slate is just a bluish gray. (like natural slate rock). Usually the darker the better. Black or slate is acceptable on a black or blue Ameraucana.

Leg color looks light in the pics, should be slate or black.

Splash colored chickens carry two copies of the diluter gene you need for blue. Blue chickens have one copy, Black has none. You get one gene from each of the parents two genes. So a black and Splash pairing will result in one copy hence a Blue chicken.
