It looks like in the picture, you have your saddle way back and your weight way back on his kidneys. That's probably what is making his back sore. You have long legs and he has a short back...plus where the saddle is placed(too far back).

Sore backs, especially in young horses, can take months to heal up. Sometimes they never heal - sore backed is one thing one never, ever wants a young horse to be.

If it's in the same place as the other horse, it's probably so footsore it doesn't even want to get over in the stall.
I wouldn't make a lot of assumptions about the horse. It looks very immature, but that can be because it's not getting fed a whole lot.

Re paints - you may want to look up the rules of the American Paint Horse Association as to what bloodlines they register and what their other requirements are.
