    Dog is back again

Yeah, now I know. Thanks for the advice on closing the thread!

    Dog is back again

Agreed. I was raised that you don't pick up a gun unless you intend to use it, and when you do, you better have good aim.

    Dog is back again

I said I wasn't asking for advice because I am already working closely with animal control, who is being very helpful. They spoke with the neighbor, and told them my rights to protect my chickens.

    Dog is back again

The animal control officer called me this afternoon and said they had called and spoken with the dog owner. They laid out my rights to shoot the dog, and also told the guy that he had advised me to do so. So now hopefully he will keep his dog contained. He was in his front yard when I drove by a...

Shooting is allowed here. We hear gunshots all the time, and I know some people kill possum and fox that attack their chickens or other pets.

    Dog is back again

Legally, we are allowed to protect our chickens. So I can call shoot the dog, then call animal control and report it, and be following the law. I would just rather avoid that, as we have to live here and we live across from this person. The HOA community has no rules about dog containment, nor...

    Dog is back again

So far today, their dog is staying behind their wireless fence. I am hoping that they raised the voltage on his collar for a bigger shock.

    Dog is back again

There are elections, which were done before we moved in. Someone from the community nominates, and then they have a vote across the community. No term limits and it takes a 75 percent majority vote to remove someone from their position. There are new elections every two years. From what I...

    Dog is back again

My plan is to document, take pictures, video, and call animal control each time the dog is in the yard.

Leashes are only required in areas considered public use places.

    Dog is back again

We are getting out as soon as possible and never will live with an HOA again. Our last house had an HOA but it was wonderful. Everyone minded their own business, and they actually used dues to pay for snow removal. So we really had no idea how bad it could be.

    Dog is back again

We checked and there is nothing about leashed pets. It is actually kind of weird since there are a lot of other little things.

    Dog is back again

The neighbor in question is the HOA president, so that won't happen

    Dog is back again

It said that no property was allowed to have electrifies wire and that any and all fencing had to be approved through the HOA board.

    Dog is back again

Honestly, I just want them to keep their dog where it belongs. I don't want to deal with a court case, or have this spiral out of control. I am not into drama...just want to live my life, have my chickens, and be left alone.

    Dog is back again

I will have to ask around and see. I haven't heard any other people complain, and when he came over the first time, and killed our chicken, the guy acted embarrassed and was apologetic. He said the dog hadn't gotten out from the wireless fence in years. I hadn't seen the dog out before the...

    Dog is back again

I will have to ask the AC officer about it.

They may be. So far, based on their actions as HOA president, I would say yes .

    Dog is back again

We are kind of stuck unfortunately. They may lose their dog, but that would most likely result in negative results for us in the long run. I hate to say it, but we may have to consider giving up our chickens. We don't have the money for a legal battle, either way. Lawyers are expensive!

    Dog is back again

I looked it up and the only local laws about dogs are the ones where you can kill them if they are attacking livestock. There is no leash law, except in areas considered public property.
