Its a tough call when the differences in the interpretation of lawful and unlawful has to be so vague. I don't think killing or wounding someone trying to steal chickens is going to be well argued in court and let the ACLU get involved your likely to become the prosecuted. Tala that you were not on your own property could turn things against you very quickly if it had become lethal. Believe me don't think for a moment I don't believe in doing what I need to do to protect family, there are few considerations that I would award anyone I perceive as a threat. They're going down. Just be ready with a good lawyer.
 
Well in CA. we have some local laws prohibiting the discharge of fire arms, but if it was me I would let off a couple of rounds to scare him and get the message across, he would definitly be taking a dump then........

Seriously, get legal advice from a useful lawyer. Where I live the Montgomery County Sheriff's Department has citizen patrol (a civilian adjunct for support roles and ride-alongs). The head of that group teaches CC and gun safety. A pro-gun law firm has a lawyer in each class distributing cards. These people know the law and are very close to LE. They know what is acceptable and what is not. They will come to your defense 24/7/365.25 anywhere in the USA.

That said, the part of my earlier post regarding pressing charges was important. If you wound somebody but do not prosecute for trespassing, you will probably get hit up for assault. If you successfully prosecute for trespassing you are immunized against a countersuit. But as above, get legal advice. My information comes from a neighbor who is friendly with a judge. (Friend Of A Friend means no more credible than Urban Legend).

Another facet of Texas trespass law is that the property owner or an authorized caretaker can shoot the trespasser.

Your life is on the line and you should take this seriously. Get legal advice, form a strategy, execute it ruthlessly.

If your strategy includes shooting somebody, be sure to use a gun that is viewed favorably by juries. Avoid military-style aggressive looking guns.

I don't believe you have your facts straight. I do know that if you have a trespasser you have to have an officer issue a Criminal tresspass warning, if they come back then charges can be filed. I worked on a large ranch and caught armed poacher/tresspassers (Man and child). Called the sheriffs dept and they sent an officer, all he said could be done was the warning. Now if he was caught back then he would go to jail. This was the same for land owner or agent. This ranch was posted and had purple paint.

Texas has the Castle Law that causes majority of the rules to change at night, LOCK AND LOAD!​

Should have called the game warden instead. They are far harder on poachers than the sheriff's office. And yes I tried to file trespassing charges on my posted property (where I live) and they told me they could send him an official warning letter and arrest him IF he came back. Pahooey baloney IMO!!!
