Hi! I'm new to this site so feeling my way through. I don't have any personal experience with chickens as of yet. I do have a lot of experience with home owner associations and CC&R's. This is from where my message originates.

In my HOA we have had neighbors with chickens and roosters so the subject has been discussed. Roosters had to go, no further discussion. Our city ordinances permit back yard chickens so our HOA board of directors decided that if a homeowner requested permission to have the chickens it would be okay as long as they followed the city ordinance.

You might familiarize yourself with your HOA governing docs so you have a thorough understanding of them and can easily paraphrase what they say. You will be the informed homeowner. Also do that with the city / county ordinance specific to backyard chickens. There are a lot of board of directors who haven't a clue but rather have an agenda as to how they want their HOA governed. If your HOA references city and county ordinance for specific types of permits, i.e. fences, roofs, encroachment to sidewalks, etc. use that as an example to your benefit. If they balk push the point diplomatically (of course) why they would adopt some city / county ordinance but reject others. Canvas your neighbors, write up a simple petition for the backyard chickens, get signatures. Again, read your governing docs cause homeowners have rights, you just have to know how to do it legally within your HOA.

Seriously!!! I thought that when we "bought" our homes and land that it was our free will to do with it what we want!!!! What is happening to this country??!! We should be able to have chickens ANYWHERE!!!)


I couldn't agree more. What we do on our own property should be our own business, not anyone else's, unless we encroach on others' rights by not containing our animals in our own space, etc. I think it is very dangerous to limit our ability to grow our own food, animals, etc. If this country's economy tanks even further, many will be looking to the small, neighboorhood farmers and backyard hobbyists for survival, as national food sources from big agribusiness start to fail in earnest and we run out of means for bailout. The idea of taxing backyard gardens is ridiculous, no doubt thought up by someone who has more money than brains. I refuse to hide under a chair.

My attorney charges about $200hr. I hesitate to involve him in anything. When people start sputtering about going to court, I never back down. Let them threaten! I always question whether someone is really, really gonna file. Take a couple days off work & write a $600 check for attorney fees? Really? Is it that important? Usually not!
 
can u say communist's lol establish ourselves as individuals and fight as a group write your senators & congressman on a daily, weekly monthly basis to get your basic rights met... i jus had my neighbor with 7 horse's on 15 acres which is totally against rules & law tell me i better not get a rooster on my 5 acres... lol... because of noise pollution... i cannot grow grass almost 30 feet from the fence line because of urine ... i do not complain because i feel he deserves the right to do as he pleases... so my question is do i let it go and still get what i want... yes ... because i am here to stay & so is he... i will try to help by buffering the sound with recycled drink holders on two sides of my very large run , my birds will lose some sun but i think that is fair. my roo will not be a free ranger so i dont see the prob... btw i ate horse dung on memorial day ... lol i was grillin & the guy decided to plow his dung piles while me doin so dust flew everywhere! i still reached out & ask him & his wife if they would like some hamburger's lol...enjoy spiteful guy cause i can smile & win... also look under federal law for HOA loop holes because they still cant take away your civil liberties... but my suggestion is. as soon as u can sell ur house to the porn industry & let the neighborhood deal with that while u drink some lemonade in a more laid back setting ...
 
People generally buy homes under HOA restrictions because they want those restrictions in order to live the way they want to. Which means no chickens next door, no junk cars parked all over the lot, etc. So just as you feel you have a right to own chickens, they have a right to live in an area that wont allow things like that; thus the HOA.

Its the same way with the Over 55 Subdivisions so popular in FL. Older people do not want to live with a lot of kids around, which is why they buy into sub divisions like that. They are relying on their HOAs to protect them with the rules and regs.

Why people keep moving into restricted sub divisions, and then complain that they can't have chickens is beyond me.
