in my area the noise made by my hens or my rooster for that matter are covered by the right to farm act. county code spells out that noise, smells, etc that are a normal part of agriculture are to be expected and must be put up. unless of course a health hazard. that means i have to put up with the sound of water pumps all night to irrigate the vineyards and the neighbors get to listen to my roo. I am zoned R40 I believe.

i know here we have a right to know who made the phone call. I would want to know if the complaint was made in fairness or not. I hope you can get through this without much problems...so sorry

Your best bet is to try for a variance that would allow you to keep a limited number of birds as pets.
 
When I checked into the legality of having chickens, I was told that it is OK for me to keep them, as long as there were fewer than 50. But I was also told that I could keep them only as long as they were not a nuisance (smell, noise, disease, insects, etc.). Where I am, the two matters are separate issues; the keeping of chickens is a local issue whereas public health is a state issue. My township is charged with investigating public health issues, then deciding if they should be forwarded to the county and state. Sounds as though this might be the case for you, too. I'm sorry to hear you got a letter because someone complained. I agree with the others in that you should make your bird area as presentable as possible. Hope that doesn't mean too much work.

Yes, my husband pointed out that we are in R-1 and the above law was for RS. We were not looking in the right place apparently when we were initially researching the laws for chickens in our area. So we ARE raising chickens against our local codes, unfortunately. All our chickens are ornamental and I don't see any difference in raising our birds versus raising parrots or any other pet bird except for the fact that they lay eggs. Sounds to me like a lot of our cities in America are racist against chickens. Maybe I should file a discrimination lawsuit. (Just Kidding)
 
Sad to read about this.I would want to move if the neighbors and city prevented the hens. I think too I would be outside every day singing and crowing for my reporting neighbors enjoyment.LOL,just kidding but I am sad for you,especially your son.My kids would be heartbroken if the city made us get rid of the chickens.
