It is really hard to tell if eggs that are shipped are infertile, so I tend to side with the seller. I am not a seller myself, however I understand their pain. The post office is not kind to boxes of eggs at all.
However, since you drove to get them, the po is not involved. There are better ways of approaching a seller than saying they were infertile. I would just say there was a problem with the hatch and only XX hatched out of the XX I bought and that is not what I expected.
