I would think that even if monies did exchange hands, the circumstances here are beyond the norm. There have to be clauses in the auction agreement that would cover unavoidable happenings. What if the birds died? Failure to complete auction due to lack of contact? Jobele needs to reread the agreement and also the laws pertaining to animal cruelty. There is a paragraph in one of them that talks about someone knowingly selling/trading, etc. to a known abuser and how they would be culpable as well. Unless this is a local operation, you would need the Federal, your State's and the buyer's State laws to read. All would come into play. Just my 2 cents.Unless you have accepted the money, if you have, the birds are that persons, if you have not, they are yours, but you may owe money to the auction, even if you chose to no sale.
