Argument with the hatchery..who's right?

Hi. I bought this young chicken from Meyer Hatchery June 18. He/she was in an "all Pullets" bin. At first I thought it was an EE pullet, but ever since they were a couple weeks old, this one and another one that the hatchery confirmed IS a cockerel (also guaranteed a hen) have been play fighting together, and they never play fight with the other four chicks, who are all pullets. I think this is an Araucana cockerel. He has green legs and yellow feet, as all Araucanas should. He's rumpless, as Auaucanas should be, but he does have a short tail. The hatchery is telling me he/she's an EE hen. Which I would prefer, but not only do I think he LOOKS like a cockerel, but he acts like one, too. Who's right?? Tough to tell with that picture. The comb looks big enough and red enough to be suspicious about, though, so I would lean toward it being a cockerel. Behavior is not the best indicator of sex at that age, because pullets can spar and they can be as aggressive as cockerels. So put the weight on appearance at this stage.
 
I've really liked Meyer because normally their customer service is very good. I'm sure they do get taken advantage of a lot. I'm pretty positive it's a cockerel...we've gone through the guessing game a lot with our own chicks hatching here....but we'll see. When and if he / she crows I'll send them a video. Though that still might be enough since hens can crow too lol...anyway thanks for the clarification. We've had Ameraucanas but not EEs or Araucanas. It gets confusing.
