Arkansas folks speak up.........

You would think since the state minimum is six, then the minimum should have been set to six.  That's ridiculous.  With the whole "grandfathered" taking place, who would be able to prove you weren't grandfathered in (aside from them being chicks, of course).  When they are grown, how would the city be able to prove they weren't already there?  Eventually, the law will be able to outlive any chicken (unless it's changed, crossing fingers for you guys) where no one would be able to get away with it, unless you have some nice neighbors.  My parents live in a town where they aren't allowed any chickens, but they have neighbors that seem cool with them being there.  They don't have any roosters crowing in the middle of the night either.  

Unbenounced to most, there are a few places that have been allowed by the state to sell a minimum of two for such ordinances. Fay Co-op is a minimum of 4 I believe.

We also have a local feed store that doesn't go by the state minimum, and I've gone in to buy one chick without a problem. The rule may be just be for large corporations. Or maybe the locals list the transactions as a product instead of a live chick for taxing purposes?
 
Ark. Stat. Ann. § 5-62-121 (2003)
§ 5-62-121. Transfer of certain chicks, ducklings, or rabbits
(a) It shall be unlawful for any person, firm, or corporation to sell or offer for sale, barter, or give away living baby chicks, rabbits, or ducklings under two (2) months of age in any quantity less than six (6).

(b) It shall be unlawful for any person, firm, or corporation to sell, offer for sale, barter, give away, or display living baby chicks, rabbits, or ducklings which have been dyed, colored, or otherwise treated so as to impart to them an artificial color.

(c) This section shall not be construed to prohibit the sale or display of natural baby chicks, rabbits, or ducklings in proper brooder facilities by hatcheries or stores engaged in the business of selling them for commercial purposes.

(d) Any person, firm, or corporation violating any of the provisions of this section shall, upon conviction, be deemed guilty of a Class C misdemeanor.

(e) Nothing in this section shall prohibit growers of living baby chicks, rabbits, ducklings, or other fowl from selling or making gifts thereof in quantities they deem appropriate.


This is the latest I could find, from 2003. This is probably one of those laws that the enforcement officials are not going to be pulling sting operations on. It will probably be ignored unless someone reports it so they have to do something, but corporations like Tractor Supply will have lawyers looking at the laws so they can set their corporate policies in accordance with them. Whether people actually choose to follow the law or even corporate policy is something else. And the “growers” have an exemption.
 
We live in rural Arkansas so no limits here, we currently have 20 chickens. My question is if anyone has any silver laced wyandotte eggs or chicks for sale? I would love a rooster and a few hens.
 
We live in Cabot, outside of city limits. The local feed store required I buy a minimum of 6 but after that they would sell singles.
