I bet it is/was something that may never have existed and you have one snooty neighbor. You know the type, the ones that SHOULD have bought in an HOA so they could be their neighbors keeper.

Lol I did my research when they lifted the no hen rule here! They opened the door wide for us chicken folk. No limits on numbers here so long as I keep em clean and no one complains about noise.

I really hope you find that you can indeed have some and that your kiddo gets his birthday wish.
 
The irony in all this: I voluntarily went over one day to chat about us maybe getting chickens, as a courtesy! This neighbor is notorious for being snooty and definitely should have bought into a HOA. She also thought you needed a Roo for eggs and I politely told her that "No, all females produce eggs." ;) Additionally, she was afraid it would smell and ruin her day while sitting out of the porch. I told her that would mean we're being negligent.

This is all "foreign" to me after growing up on acres of land in the country. Very seldom did one neighbor have issue with another. For some odd reason we never had chickens! Putting money on my mom thinking they'd be smelly.
 
There are sooooo many misconceptions about birds. :rolleyes:

For example I was once told that the first eggs a chicken lays must be thrown out because they are full of icky stuff. Icky stuff? I have also heard many times about needing a rooster in order to get eggs. The puzzled look I got when I politely asked if they thought the commercial egg producers had roosters was priceless.

I would lay money on the neighbor not having a leg to stand on. Way to create a rift snooty neighbor!

Just so you know my situation.... I am in the middle of my fairly good sized city. I have 31 chickens. I have no roosters. I clean my coops (yes coops) once or twice a month as needed. My birds lay beautiful eggs in nice coops that usually smell of fresh pine shavings. My birds are quieter then the dogs in the hood. They do make noise when someone lays an egg but it never lasts long. Seven plus years and no complaints.

I would check into that "rule" and then run your household as you choose. Just know that if you share a property line she may be crabby. I would put the coop away from that side. Plant pretty flowers around the run, make an attractive coop and tell her to mind her own beeswax.

A little bit of an update. I e-mailed the realtor who sold us our house. He sent the note onto the former owners. They said that the original developer imposed restrictions on raising poultry on the properties. IT's apparently in the title report or insurance policy (IE buried). I'm digging for it now and will visit the neighbors in the same camp as me to gain numbers!

Stay tuned! My son asked about the chickens again - I don't think it sank in when I said we probably couldn't get them - saying we have to start on the coop soon before winter and before we get chicks in the spring. So I am energized to make it happen!

She might like that! haha! An interesting fact is that we've bought their dog a christmas present almost every year, since my son loves playing with it, a ball or something small like that. And we don't even have a dog of our own! We've paid being the "good neighbor" forward.
