Can employers do this?

Employment laws vary from state to state. Here in California, half of what they are doing is illegal. Here, for every 5 hours you work, you HAVE to have meal periods of at least 30 minutes, and after 24 hours on, there are required 8 hour rest periods. So that wouldn't fly here. There is also this issue of overtime, hostile work environment, exhibiting threatening manners that cause employees to be fearful, all of which is illegal here. Also here in CA, 8 hour regular pay, next 4 is overtime, next 4 is double time, and after that it is called "Golden time" - triple.

The way I read this, him being pulled from his station and then being written up for it - he needs to speak with the labor board for your state. I don't know how strict your state is, but here he would win hands down.
 
For example... Michigan is an "at will" state. You work at the will of the employer and can be terminated at any time for any reason. I had guys who put in for a day off so they could go down to detroit to watch the final 4 in person. Sorry, the day off from his area went to the guy who A) put in for it first B) has 5 years more senority and C) has only asked me for 1 day off in the last decade.

Needless to say that employee called in. Called his cell phone. No answer. Called his girlfriends cell. Could hear both of them cheering as they scored. Confirmed that no he wasn't sick as stated when he called in. Told the girlfriend to have him call me on monday (because it was a friday) so we could arrange for him to pick up his final check. By monday I had him replaced because I interviewed his replacement about an hour after I got off the phone with them.

Did I enjoy doing this? Nope. Was I effective at my job? Yup.

Ewe... The environment does seem hostile, but remember how bad the economy is.

"At will state" dosent really mean that they can fire you for ANY reason...
They have to make "something" up at least...

And if its not for any reason real good.. (like the employee failed a drug test... or the employee stole... the employee violated a safety procedure... etc.....).. the employee CAN collect unemployment off of them..

only if they were truely an employee. We used a temp agency to head hunt for us. The temp agency can pay the unemployment if their guys flake out.

Im so sorry your hubby is going through this. I kinda know what its like. I work at a retail place in Decatur name shall be ommited but if you miss more than 3 days a year you can be fired. They have scaled down employees so much that we are doing at least 4 peoples jobs and you had better get all your work done. Unoin talk is prohibited. You will be fired. There are no jobs here that pay any decent wage so I know how you feel. Stuck between a rock and a hard place. I hope things get better for you soon. Hang in there
 
UH OH!

Hubby told me that he only allows ONE ten minute break and ONE twenty minute lunch break in the 10 hours he worked in a day. Heavy assembly work involving platforms, different equipments on Caterpillar tractors (those HUGE yellow trucks for mining companies). As far as he is concerned, he is going to work until another job is better pay and better work evironment. Heck he is an EMT and sees whats going on...accidents been happening and workers are very tired.

Hubby said there is MORE to it. But they do NOT care or go along with the rules.

As for unemployment, they told the employees they will NOT get it, they will make sure of it. I don't know how one supervisor can control the unemployment benefits approval....I've been thru that crap before with my own employer and got fired, and still got unemployment but no renewal on the end of term of my unemployment status.

Hubby feels good in supporting the family with extra income and better insurance that Medicaid is not able to pay, like my dd's orthodontics she will be having in five months.

Today one employee, another female co worker, gave them the two weeks notice, got tired of the BS over the broken hoast overhead (that carries in heavy pieces to one place to another). The supervisor gave them hell when they walked in to work in the morning saying who broke it because it COST them money. Heck, it was in perfect working condition when they left their shift! There were some second shift (parts and stocking only) so they must have been playing with it or messing around with it and it broke. Good God! Dont the supervisor ASK anything FIRST what has happened instead of jumping on them when they first got to work this morning???!!!!

Otherwise it was a nice day for him tho. A little better than yesterday.
