Chicken owner charged after shooting dog.

Most cities have amended the laws to reflect "air" guns as firearms (remember this type of violation of your rights when you vote). I suspect the officers felt compelled or required to write the citation based on the firearm violation. I think the DA will have a hard time on the other charge. Most likely the only charge that will stick is the firearm. I have a good friend that is a LEO and he bought his kid a Daisy and he can only shoot it when he comes to my house.

My way to combat this is to be educated. I called the California Fish and game and asked them what I can shoot or trap to protect my chickens/ducks/goats. I have the date, time, name, phone number and ID number of who I spoke to. They referred me to the codes and advised that ANY 4 legged animal can be shot to protect live stock in my county. Of course, I have to be 150 yards from a "dwelling" of have consent from the owner (no problems here). So far in just the past 4 months, I have killed 1 fox, 2 coyotes, 2 raccoons, 1 bobcat and 1 ferrell dog (no collar).
 
I have mixed feeling on this one.

I feel the dog owner should have had control of his dog, and I believe the chicken owner should not have shot the dog.

I feel this way because there was no mention of the dog trying to hurt the chickens. The chicken owner could have caught the dog and since being in the city limits, called animal control to pick it up.
And the dog owner should be following the leash law.

If dogs are trying to get my chickens, they are dead dogs, and I have the legal right to shoot them. The owner of the dog is legally responsible to pay me for losses. But if they are just on my property, I do not have the legal right to shoot them, and am liable if I do.

We can make two assumtions, one, there is no history behind his actions and he just shot the dog, the other is that there IS a history of loss and a possible history of that breed of dog giving him problems in the past (there was mention that another neigbor had the same breed dog). Either way is sucks for him. I know I would fight it.
 
Best thing to do from this is learn. Mistakes are the best lessons ever given.

Every State, County, City, Town has different regulations and definitions with in their statute. I sugest that we all, if not already, get brushed up on our own.

Also, concider this. It is very possible that the news paper had chose what to say and leave out to make the story apeal to people. I'd like to say, from personal experance, that both were charged however the paper didn't want to print that to make the dog owner out to be the victim. Cases are rarely black and white, both parties are usually at fault in one way or another.

But I know my local law enforcement VERY well and know that at least where I live if anything threatened my livestock (cows, horses and chickens) they would have my back for shooting durring an in progress attack, but only in progress. Other than than I would have to call them and have them take care of the situation. However were I live I'm alloud to shoot on my property.

I love rural Colorado! Oregon is pretty but... Colorado is where it's at!

Ya just don't know which way this one is going to go.... Sounds like possible mistaken identity... Hopefully the former dog owner learned something valuable. I am sure the chicken owner did...
Sad thing. I sure feel for him protecting his pets, meal ticket, food, or entertainment. It is very irrisponsible for people to let their animals run at large... If a pellet gun went off when I was walking my dog... I am sure I would hear it.. Where exactly was the dog owner that he didn't? Wow what an irrisponsible person to call the sherrif and shurck his responsibilities.... That is such a problem... Blame someone else... The chicken owner clearly protected his stock/pets by building proper housing.... And yes folks.. Dogs can get in anyway... They DIG!!! My nieghbor has a dog of the same breed that is a chronic nuisance in the chicken coup... and kills everything he can.... It is a serious loss if you have rare birds. No mention was made about the type of birds the man had. I know some of the rare birds can run into the 100's of dollars. The dog may be worth less than the pen of chickens.
