Hi fellow coloradians!
I posted earlier about trying to talk to my HOA and it not going well. We currently have nothing in the HOA about farm animals. My husband and I have now seen 2 lawyers and both reviews all of the convenants and said we should be legally able to have chickens. Anyway... we have now been given a verbal no from the board of directors, we asked for that in writing but haven't heard back....
So I contacted Bill Vogrin from the Gazette who writes the Side Streets columns. He wants to do a story on us!!!! I am soo excited, he has asked to speak to the Board of directors personally. I am really hoping this might put some pressure on the BOD to give us permission.

If there is nothing in the HOA rules about having chickens and poultry..Why woukld you need permission?

And what wsmith said about HOA's that goes for just plain old nosy neighbors who have nothing better to do. So glad to not have them anymore.

Yes a week ago, my husband was ready to move. We saw 4 houses in the Monument/black forest area, met with 2 lawyers, and really talked about moving, but financially it would be a hit, and I really like where we live (I'm on the NW side of town) I am a teacher and have worked for both D-11 and D-20 and think getting my foot in the door at a new district might be hard right now.
So for now... we want to stay in place.
So now that that is decided, we decided to push our luck and fight the HOA. Thursday we were given a verbal "no" and today we got an email that said the board has 30 days to decide about our request. It's funny that they think it is a request, where as we see it as our right (since it is not specifically in violation of any bylaw). 2 lawyers agreed~

I'll keep you all posted. I am hoping to get my 4 chickies outside by June. We will see. I really want all of this to be settled before taking my birdies outside.
I have one buff orpington, one black australop, one americana, and one dominique!

UPDATE: Equine Herpesvirus Confirmed in Colorado Horse


The Colorado Department of Agriculture is investigating one confirmed case of Equine
Herpesvirus (EHV1) within the state;
a quarantine has been placed on a Douglas County premises.


The affected horse was imported by a private owner from Iowa through a transport company
and was euthanized after showing severe neurological signs associated with the disease. There
are three other facilities in Colorado that received horses from the same transport company.
Those horses are isolated and are being closely monitored for any clinical signs of EHV.

Unlike the EHV-1 outbreak in 2011, this case is not associated with any equine show or event.
To date, no other horses have become ill with similar signs. With the exception of the index
and direct contact horses’ premises the state veterinarian is not recommending movement or
event restrictions.

EHV-1 is not transmissible to people; it can be a serious disease of horses that can cause
respiratory, neurologic disease and death. The most common way for EHV-1 to spread is by direct horse to horse contact. The virus can also spread through the air, contaminated
equipment, clothing and hands.

Symptoms include fever, decreased coordination, nasal discharge, urine dribbling, loss of tail
tone, hind limb weakness, leaning against a wall or fence to maintain balance, lethargy, and the
inability to rise. While there is no cure, the symptoms of the disease may be treatable.

I say Props to everyone fighting for chicken ownership! And my sympathies to anyone dealing with nosy neighbors. I have just had my first experience with that. Someone, and I am 99.9% sure I know who, called code enforcement on me for having a messy backyard. Kicker is that I am not in an HOA, so they called in under the health laws because we left some green garden fencing down. We had been working on the yard so it was a bit messy but really???

So... We needed a new coop anyway and have decided to paint it orange and blue. I am going for fun tacky chic. I am going to give those nosy neatnicks something to wince at and not a thing to call about.

We had a neighbor down the street that kept calling and complaining about people in the neighborhood. It was just a bunch silly things, real random stuff. I think that this family just had to have controversy in their life to feel good.

At any rate, one of our neighbors had enough...they lived right across the street from this pair of complainers and they had just reached the end of their rope with these people. They painted their house BRIGHT Urine Yellow...absolutely the brightest glow in the dark shade of yellow that they could find. You could probably see their house from space without the aid of satelite imagery...When this pair came over to complain and ask why...they told them why. And the city, I think, had had enough of them as well and did nothing about their REPEATED complaints. They then tried to get all of us to form a coalition and file a complaint with the city...NOT HAPPENING. I was tactful but very direct as to why I would not join their Coalition Movement. From what i'm told, several others were less tactful...

They finally quit opening their window shades and prying on everybody. After 6 months of their window shades being drawn and not a peep from them, they moved and good ridance to them.

I hope that all works out for you...very nice to hear that there is legal support for your position.

Hehehe...I love your coop plans. Oh, you like spying into my yard? Here's something for you to look at.

I'm so happy where I am now. I lived in a condo; before that, I was in a townhouse, both with HOAs. Now I'm on 5 acres with none of that nonsense, and I have a tractor parked in my front yard. Even if my neighbors were close enough to see what we've got going on, I doubt they would be able to see past all the stuff they have sitting out on their own properties.
