Pekins have only 4 toes and also single/straight combs.  Can't see combs on your chicks but you mentioned they had 5 toes... making yours very likely silkie mixes. Not cross, unless his silkies are no good for matching the Standard.
 
Not cross as silkie black skin is dominant, so those chicks should have had either dark or greenish/bluish legs instead of so clear yellow legs and beaks.
 
Yellow skin is a recessive, which means both parents at least had to be carriers for the yellow skin gene.  AFAIK silkies normally don't have the yellow skin gene.
 
The more informed you are the better if it comes to words with that so called breeder!
 
p.s. could it be after his contact with you and others(?) about chicks not having silky feathering, he has decided to change tactics and advertise Very Special Pekins?
