Does the neighbor count as a pest?

Put barbwire rolls at the top of your fences and see him trespass then.. haha

In our state you can shoot a tresspasser as long as they are looking at you :}

This is why I will never live in the suburbs. We lived in one for a few years, and it was awful. Humans are not meant to live that close to people they aren't related to. Even some relations should have to live far away.

Personally, I would file harrassment and trespassing charges. You don't have to have witnessed it. You have proof. On the days he complained he could have only gotten the information by trespassing. The next time he is friendly and tries to speak to you in the yard tell him the truth. Tell him trespassing is illegal and he needs to keep on his own side of the line. Don't forget to lodge a few complaints against him as well. His lawnmower is too loud. His leaf blower is too loud. He scares the kids when he looks over the fence at them. He harrasses you dog and makes it bark. He keeps disturbing your roosters by looking over the fence and making them crow. Be the squeaky wheel. Become the PITA.

Darlin', a good offense is the best defense. Turn the tables, post NO TRESPASSING signs around your backyard and a "Smile, you're being photographed" sign with a camera. I wouldn't put up with this crud for anything.
 
I agree with horsejody. I kept quiet with my neighbors for 6 years and endured all their ridiculous comments. I'm not taking it anymore. They are going to see a new side of me this spring when everyone starts going outside again. I just saw my neighbor out behind my property (wooded) spying into my backyard at the chickens to see if anything "new" had been added this past weekend. Keeping quiet got me nowhere and they don't stop so I'm going to see what NOT being quiet does. Not ugly just not passive....

You can measure the loudness of your roosters and get readings from other things in the neighborhood. You may be surprised at how many things are louder than a rooster. Take your evidence to court. And don't be afraid to tell your neighbor very frankly that you know it's him. Don't threaten him, but tell him that his harrassment and forcing you to get rid of chickens may turn you into a bad neighbor. Remind him that good neighbors make an effort to get along. If he has a problem, he should speak to you about it before he runs around and complains to the authorities.
 
No one has mentioned talking to an attorney. A counter suit for harassment sure sounds like a nice idea. I am certainly no attorney! I'd want to know, though.

I suspect you need the "no trespassing" sign, and I do not believe you have to catch them trespassing, esp. if you go with the video camera and have it recorded.

Lots of good suggestions here. If you go to court well enough armed, maybe the judge will get disgusted and give you a pass on the barn and th 50 feet.
