While I was out the ACO left a message that the Chief of Police decided there will be no police report, that the ACO's report will suffice. She also wanted to drop info off and I again left her a message saying to please do so - so far she hasn't. Theattorney didn't advise me re: the rabies/quarantine issue but the ACO made it clear they are not considering it a dog bite case - we had blood, scratches, saliva so I still think cautions are necessary -

DO NOT TALK TO ANYONE but your lawyer, been there done this also. Even if they say you have to talk to them, do not!!! IT is usually a trap. Your lawyer will set something up if need be.

I have not returned their insurance company's call. They called again today.

In other news, the ACO finally dropped off paperwork today, after I asked her to please do so without further time passing. We also spoke on the phone and she again said the situation did not call for quarantine, but that they were doing so. I said 'so the dog is being kept in their house?' and she kind of hedged. She said quarantine is usually just for deep bleeding puncture wounds according to the state. I tried calling the state several times but never got a human.

Amongst the things she later dropped off:

- a short written report with inaccuracies
- copy of paperwork indicating dog had its rabies vaccine
- copy of 2 complaints issued by animal control (they didn't do this till I said I wanted it done) - one for dog at large, and the other for dog injuring human and chicken. complaint notes nothing needs to be done unless followed by summons (yet herwritten report describes the complaints as summons)
- ****copy of ordinance saying chickens are not legal in town**** MAYDAY - never saw this before - it was not in town's ord book when i reviewed every single page of the ords at town hall 2 summers ago, yet ord is dated 1980 (the records in town used to be in shambles, getting cleaned up more recently). others in town have had chickens over the years but i think i am the only one now. i don't know why she felt the need to give me that ord on top of all the other crud. maybe they will try to make me lose my babies now (this would constitute a nightmare for me

), and/or maybe now ellie's med care won't be covered.

Ellie definitely has break/dislocation in her middle toe right foot, and it hurts. She gets around but then keeps holding it up. Someone who went through asimilar experience with her hen taped the bad toe to a good one for 5 weeks and it got much better. If that's the best route I'll still have to take her to the vetbecause I can't do it one handed, that's for sure....

How nice that they provided a copy of the 'missing' ord. I asked my city hall to produce an ord against having chickens, and was initially told that there was nothing on the books. Three days later they inform me that there IS an ord against owning 'livestock' in town. So I figue I'll just run out and get some pea fowl and REALLY annoy people in town!

I think I would speak with the city clerk and ask to be given time to speak before either the city council or the Ordinance committee about allowing you to keep your birds and to make an amendment to the current ord. Better yet, talk to your lawyer about it!

And about the dog NOT being quarantined... sorry but that is completely UNACCEPTABLE!

Maybe you should now include the ACO, PD, and the township for finding the missing ord's. in your lawsuit!
 
What a crappy town you live in!!! I'm sorry, but it sounds like a bunch of yahoos and jerks running it.

I so hope you feel better soon. I know you are frustrated with your inability to get things done. Are there any church youth groups around you that might be able to help out? 4-H? Boy or Girl Scouts? The less you use that arm the faster it will heal.

Fingers crossed that Ellie will be okay. She has had such a hard time of it.

JJ, don't be surprised if a check from the dog owner's insurance company-along with a "we're so sorry for your suffering and want to do everything we can to help" letter suddenly shows up in your mailbox.

If and when it shows up, it will likely be for an amount that will tempt you to run down and throw in the bank. Don't Do It. The moment you sign and deposit/cash that check, you are essentially accepting a settlement from the insurance company.

Say, for the sake of argument, that you've racked up $4,000.00 in expenses at this point and then you receive a check from them for $6,000.00. It may seem like they're doing you a favor, but all they're doing is tricking you into absolving them of any obligation beyond that dollar amount. If your total expenses come in under, that's great..but if you should require surgery, therapy, etc..they will not be liable for the cost. They're pretty good about sending those checks out before all of the bills come in. Some guy has $300.00 in bills, they send a check for $800.00 that he cashes, then he receives another $1200.00 in bills..and he's on the hook for it.

What others have said can't be stressed enough-don't speak to anybody who is in any capacity a representative of the dog owner and certainly not the dog owner herself. Refer everybody to your lawyer, and immediately notify him of any correspondence-including checks-that you may receive.

I hope this makes sense..I'm so tired I'm having trouble getting my thoughts together. I'm sorry you and Ellie are still suffering and I continue to hope this all works out in your favor-especially in light of the recently discovered ordinance.
