RTF laws are definitely worth checking for anyone with this dilemma. Unfortunately in NJ, it doesn't apply to a situation like mine. In brief, one either has to have more tham 5 acres (I don't) or the farm activity has to produce in excess of $50K (I have 2 birds).
I really appreciate everyone's supportive reactions as well as ideas.
Ugh, Maybe your lawyer can find a loophole somehow. 2 hens shouldn't be a big deal to anyone though. I do remember NJ having some crazy renters laws, but I was hoping that might help.
I am so very sorry about the irresponsible dog owners. It makes me so mad. I have had dogs for many years, and it has always been extremely important for me to not only respect my neighbors, but to respect the safety of my dogs as well. We recently moved to an agricultral area, and the very first thing we did before we moved in...put up a fenced area for our dogs. I didn't want my "city" dogs harrassing my neighbors horses or farm. It's not fair to my neighbor, and it's not fair to my dogs.
My understanding was that you needed to have at least an acre to have chickens. I would look into state laws that might override? Contact a local poultry club for help finding the laws??
I mean like extra laws other than what you found that could help you.
If you don't get a notice saying that you have to get rid of the chickens, just keep them. If ACO wants to play hardball and tells you to get rid of the chickens, you have plenty to hold against them for their inaction on the dog issue. When the dust settles from your current dilemma, seek to change the laws. After you settle or win in court, contact you city council rep and explain that you researched and the law wasn't evident. Ask for a change in the law or an exception. Don't muddy the waters right now by intermingling the 2 issues. You were wronged. You were injured. Leave it at that for right now.
I agree completely. Not even going to raise it. And if they do, I am going to point out how they are failing beyond miserably to enforce their ordinances w/regard to the people flooding me out with their development by failing to follow rules, a situation where someone is being greviously harmed, unlike in the case of my 2 little feather-friends. Of course, none ofthat matters because the people involved with one are different peoplethan those involved withthe other. The ACO 'serves' a number of towns in the area. But in any case, not going to open that can ofworms further right now ifthey don't.
Ellie and I just got back from the 3rd 1+ hour round trip vet visit since this happened (hard on poor Ellie). Poor thing now has her right foot entirely wrapped and splinted. The vet put her back in the carrier without taking the poop out that she made on the way to the vets and now the wrapped foot is already covered in poo. So frustrating - he didn't let me go in the back room when he was doing her foot or I would have taken care of it myself. He says she should stay in the wrapping/splint for at least 2 weeks but that 3 would bebetter. It isn't supposed to get wet. Not goingto be easy. And I don't think she can jump up or down like that so I don't know what I'll do about hersleeping arrangements - would be easier to figure out with 2 hands!
Cranium excrements are just trying to get you all worked up about no chickens...like if you didn't have BJ and Ellie you wouldn't have been injured...Bucket fulla Splort to me!!!
