to some extent they are right ... it is a dogs instinct to attack and kill animals --- it's what they were bred for

this does not excuse the owner or animal control .... at a minimum the dog owner should be paying medical bills and replacement costs

you should also consider filing a complaint with animal control --- maybe if it happens again you can have the dog put down ..... if the owner is not properly taking care of his animals then he does not deserve to own them.

Aren't you also struggling with flooding by another neighbor that illigally built something? I remember reading about the other time Ellie was attacked, I think you've had enough problems to contact the local news and give them a good story! Tell them about how you've struggled with the illigal flooding of your property, how they responded by saying "it's your problem and we're going to do it no matter what it costs you", how the people in charge aren't doing a thing about it. Tell them how you had to deal with the last attack and now this attack and how animal control and the sherriff both blew you off! The media loves stuff like that, don't they? I'm sure with ALL of this you can find at least one lawyer who'll help you.

I would call law enforcement and insist that charges be pressed. It is your right to do so. I would also send all charges to the dog owner. Don't put it on your insurance. Put it on their homeowner's. Let their rates go up, not yours. I would send a letter to the dog owner reuesting their homeowner's insurance information. These type of dog owner's digust me. If you need the homeowner's insurance sooner than you can get it by requesting it in writing, have somebody else call the dog owner. Don't talk to the owner yourself if you don't know her well. Have somebody else call. If you don't have a lawyer, have a friend call as your agent. They should just say, "I am calling on behalf of JJ. She has has medical and veterinary expenses and will need you homeowner's insurance information." If she doesn't have insurance, she will just have to bear the financial burden of her irresponsibility. If the dog owner left the message on your answeringmachine, save the recording.

I would really consider getting a gun if I were you. This has gone too far.
 
Wow I hope you (and Ellie) are feeling better soon. Your AC should do a LOT more. My son was bitten by a dog who lives down the road (not serious but broke the skin - thank God he was wearing jeans) and I called public health, they called animal control (and this is 5pm on a Friday). Wow AC called me back, I think they (or the sheriff) had spoken to the dog owner, dog was quarantined on the property pending proof of rabies, etc. within an hour. They were serious. (I won't get started on the dog, who was barking at me through MY fence last week.)

I'd advise a fence, and if the dog owner has homeowners insurance the insurance should be paying - it won't matter how broke the owner is.

This is what I would do.
Go to the police dept. for the dog bite. Find out who the boss of the guy who came and said a chicken is not a pet and have him fired! It doesn't matter if it was a chicken you were also bit, the dog should be put down! File a claim for medical bills and pain and suffering in a few weeks. Document everything, Medical bills how long it hurt, pain meds bandages ect. Call one of those TV court shows so the whole USA will know that chickens are pets and if your dog attacks one they will pay!
